Motion by Commissioner LaDue and seconded by Commissioner Thorud to amend 4/18 to read "Th~/l the proposed use will not adversely impact traffic in the area." Motion carried. Voting Yes: Chairperson Bawden, Commissioners LaDue, Thorud, Deemer, Hen~sen, and Terry. Voting No: None. Absent: Commissioner Hollarid. Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend 4/I9 through //27 ~ the affirmative. Further Discussion: Commissioner Deemer stated that the operation has been going on for 14 year~ and is not going to change substantially. Commissioner Hendriksen stated he didn't feel all of th~ items should be in the affirmative. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, La.Due, Terry, and Tho~d. Voting No: Commissioner Hendriksen. Absent: Commissioner Holland. Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend that City Council adopt the amended Findings of Fact relating to Commercial Asphalt's request for a conditional use permit for a hot m~x asphalt plant. MotiOn carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Terry, and Tho~d. Voting No: Commissioner Hendriksen. Absent: Commissioner Holland. The planning Commission proceeded to review the terms of the CUP. Moffon by Commissioner Deemer and seconded by Commissioner LaDue to amend g4 to read "Tha._t any stock piles of material shall be limited to a maximum height of 35 feet as measured from the ~isting ground elevation over which it is placed and shall be located no closer than 20 feet to any l~roperty boundary." Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, La.Due, Hendriksen, Ten'p, and Thomd. Voting No: None. Absent: CommissionerFlolland. Commissioner Hendriksen felt the Commission should put in a term requiring that the odor prob.[em be addressed ff brought to the permit holder's attention. Cha~erson Bawden noted that the CUP requires compliance with the MPCA standards, and bey~d that, odors are difficult to enforce because it is such a subjective issue. Co~ssioner Deemer suggested puffing in a condition that requires the permit holder to crush at least/Once a year thereby promoting usage of the recycled product. He felt this would reduce the volu~e taken in and at the same time encourage disposal of it. The applicant agreed that this would not pose a problem as they are already crushing at least once a yeari- Consensus of the Commission was to direct Staff to add a term requiring a minimum crushing of once~a year similar to that placed on the Bury & Carlson CUP. MotiOn by Commissioner Deemer and seconded by Commissioner Terry to recommend that City Council approve the issuance of a conditional use permit to Commercial Asphalt for a hot mix asph~t plant and adopt Resolution g95-02-__ declaring terms of same, as amended.
