Co~ mcilmember RESOLUTION TOWNHOMES introduced the following resolution and moved for its adoption: RESOLUTION GRANTING FINAL PLAT APPROVAL OF. RUM RIVER HILLS ~ WHEREAS, Wilber F. Dom :Yr. and Thomas W. Anderson, hereafter referred to as "Developers", have properly applied for plat approval of the following described property located in ~e City of Ramsey: : i Lot t, Block 2 and Outlot C, Rum River Hills, Anoka County, Minnesota. (. WHEREAS, On April 6, 1993, the Planning Commission reviewed a sketch plan for R~m River Hills Townhomes and recommended City Council approval of the sketch plan c6ntingent upon the Developers accomplishing a number of items that would alleviate the City's c6ncem with the proposal to develop urban type density units in the absence of sanitary sewer and m~nicipal water, and : WHEREAS, On December 7, t993, the Developers approached the Planning C6mmission and reported compliance with all of the sketch plan contingencies with the exception o~a written favorable review from Metro Council. The Planning Commission recommended that Ci_ty Council grant sketch plan approval to Rum River Hills Townhomes in the absence of a favorable review from Metro Council; and } WHEREAS, .On March 8, 1994, the City Council tabled the request for sketch plan approval and directed City Staff to develop criteria to be used in reviewing proposals that deviate fi.bm the 4/40 density rule and the Comprehensive Plan for extension of public utilities; and . ~ WHEREAS, On April 26, 1994, the City Council entered into an addendum to the d~velopment agreement for Rum River Hills where in the City affirmed it's commitment to develop c~teria that would permit consideration of Rum River Hills Townhomes; and i~ WHEREAS, On August 2 and August 9, I994, respectively, City Staff presented the eX- urban review criteria to the Planning Commission and City Council, both of which felt that the re_solution was nebulous; and ~ WHEREAS, On September 1, 1994, City Staff issued a memo to City Council advising thfit it would be in the Citfs best interest to deal with proposals that deviate from the 4/40 density role and the Comprehensive Plan on a case by case basis; and i WHEREAS,.. ~On September 12, 1994, City Council approved the sketch plan for Rum River Hills Townhomes to bring closure to the development of the P.U.D. and provide for a more cCmpatible housing density adjacent to single family homes; and WHEREAS, On November 1, 1994, the Planning Commission conducted public hearing r~garding the proposed preliminary plat for Rum River Hills Townhomes and recommended City Council approval of same; and .. WHEREAS, On December 13, 1994, the City Council granted preliminary plat approval to Rum River Hills Townhomes for the development of 12 units to be served by a private road and On-site septic and well, and park dedication to consist of a cash payment. !
