<br /> RUM RIVER HILLS TOWNHOMES

<br />THIS AGREEMENT, made and entered into by and between the CITY OF
<br />
<br /> RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and WILBUR F.
<br /> DORN and JACQUELINE A. DORN, husband and wife, whose address is 16610 Fluorine
<br /> Street N.W., Ramsey, Mn 553403, and THOMAS W. ANDERSON AND PAULA E.
<br /> ANDERSON, husband and wife, whose address is 16831 Helium Street N.W., Ramsey, Mn
<br /> 55_303, and GORHAM BUILDERS, INC., a MinnesOta corporation whose address is 3538
<br /> Mississippi Drive N.W., Coon Rapids, Mn 55433 ("the DEVELOPERS").
<br /> : WITNESSETH:

<br /> i WHEREAS, the DEVELOPERS are the fee owners and purchasers of the following
<br /> described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota,
<br /> a~d legally described as follows:
<br />
<br /> ~; Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, and 13, Block 1, RUM RIVER HII.LS
<br />
<br /> '~ TOWNHOMES, Anoka County, Minnesota
<br />the "Subject Property"; and
<br />
<br /> ~ WHEREAS, on February 28, 1995, pursuant to Resolution 95-02-__, the CITY
<br />approved the final plat of the Subject Property which plat is known as RUM RIVER HILLS
<br />TOWNHOMES (the "Plat") contingent on certain requirements, including the DEVELOPERS
<br />and CITY entering into this contract; and
<br />
<br /> ! WHEREAS, the final plat for the Subject Property conforms to the preliminary plat for
<br />Rnm River Hills Townhomes approved by the CITY on December 13, 1994; and
<br />
<br /> ~ WHEREAS, no expenditure of CITY funds, will be made until the City Code escrow
<br />requirements have been fulfilled by the DEVELOPERSi and
<br />
<br /> 5 WHEREAS, there are no Stage I required improvements as this development is to be
<br />serviced by on-site septic systems and wells and a private street, with the street to be owned and
<br />maintained by the property owners association consisting of owners of all the properties included
<br />within the plat; and
