i <br />,I <br /> <br />I <br />I <br />I <br /> <br />,I <br /> i <br /> <br /> I <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> I <br /> <br /> WHERE~S, the Stage II improvements required of the DEVELOPER shall be a street <br />light located at the intersection of 171st Avenue N.W. and State Trunk Highway #47 and a street <br />sign at the inters~tion of Iodine Street N.W. and the private street to be constructed by the <br />DEVELOPER ingressing and egressing the plat (the "Private Improvements"); and <br /> <br /> WHERE4S, the DEVELOPERS desire to construct the Private Improvements, as <br />described on the DEVELOPER'S plans prepared by Hakanson Anderson Associates, Inc., dated <br />December 5, 1994~ Revision date February 9, 1.995. <br /> <br /> WHEREA~S, the DEVELOPER is required to provide to the CITY, recordable, <br />permanent easem~ts granting to the DEVELOPER the right to construct alternate individual <br />septic systems on ~operty adjacent to the Subject Property (the "Permanent Easements"); and <br /> <br /> WHERE~S, the DEVELOPER has evidenced to the CITY that said Permanent <br />Easements have be~n recorded as Anoka County Recorder Document Numbers 1148929, 673164, <br /> <br />673167. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />5 <br /> <br />IMPROVEMENTS. AND FINANCIAL GUARANTEES <br /> <br />City Code Comoliance. That the DEVELOPERS will develop the Plat in <br />accordance with the City Code, Section 9.50, entitled "Subdivision". <br /> <br />Conformance with Plan. The Plat. shall be developed pursuant to the final plat <br />consisting of one (1) sheet. <br /> <br />Inc0rooration of All City Code Reauirements. That the recitals above and <br />the ~r~visions of the City Charter, Subdi(,ision Chapter, Zoning Chapter and Public <br />Imp~rovement Chapter of the CITY Code as amended to date hereof, are <br />incorporated herein by reference. <br /> <br />lmO'rovements To Be Coll~tructed. The DEVELOPERS agree to construct <br />the-Ih-irate Improvements according to the terms and conditions of this contract and <br />in a~cordance with DEVELOPERS' plans submitted to the CITY. Said plans <br />shall be in genera/conformance with the Grading and Drainage Plan plan consisting <br />of .one (1) sheet, prepared by Hakanson Anderson Associates, Inc. and dated <br />DecOmber 5, 1994, Revision date February 9, 1995, and Septic System Design <br />Repbrt prepared by Hakanson Anderson Associates, Inc. dated December 1, 1994 <br />and ,Revised December 5, 1994. Further, the DEVELOPERS herein agree not to <br />release the Permanent Easements for alternate individual septic systems described in <br />Anoka County Recorder Document Numbers 1148929, 673164 and 673167, <br />witl~out prior authorization from the CITY to do so. Further, the <br />DEVELOPERS herein agree that there shall be homeowner's covenants that <br />clea~ly establish responsibility for the on-going maintenance of the Private <br />Improvements. <br /> <br /> <br />
