PaWnbrokers 7. 3 7. 3.01 § 7.14 Pawnbrokers Definitions. When used in this section, the following words shall mean: City. The City of Ramsey, An°ka County, Minnesota, ~: Licensed Premises. The specific building which has been licensed pursuant to thi~secfion. '~Licensed Premises" does not include any out buildings, attached or detached to the licensed premises. Pawnbroker, A person who loans money on deposit or pledge of personal property or other valuable thing; who deals in the purchasing of personal property or other valuable thing on condition of selling the same back again at a stipulated price; or who loans money secured by ~hattel mortgage or by personal property, taking possession of the property or any part thereof so !mortgaged. To the extent that a pawnbroker business includes buying personal property previously used,'rented, or leased, the provisions of this Section shall be applicable. Any bank, sa~ngs and loan association, or credit union shall not be deemed a pawnbroker for purposes of this Section. Receive. To purchase, accept for sale on consignment or take in pawn any seCOndhand good. ii Secondhand Goods Dealer, Any person, partnership, firm or corporation w~se regular business includes selling or receiving any tangible personal properties, excluding motor vehicles, previously used, rented or leased. The term secondhand goods dealer shall include pawnbrokers. Exemptions. Secondhand Goods Dealer shall not apply to or include the a. The sale of secondhand goods where all of the following'are present. 1. The sale is held on property occupied as a dwelling by the seller or owned, rented or leased by a charitable or political organization; 2. The items offered for sale are owned by the occupant; 3. That no sale exceeds a period of 96 consecutive hours; . 4. That no more than four sales are held in any 12 month period; 5. That none of the items offered for sale shall have been purchased for resale or received on consignment for purpose of resale. b. The sale of secondhand books or magazines. c. The sale of goods at an auction held by an auctioneer. d. The business of buying or selling only those secondhand goods taken as part or full payment for new goods and where such business is incident to and not the primary business of a person. e. A bulk sale of property from a merchant, manufacturer or wholesaler having an established a place of business or of goods sold at open sale from bankrupt stock.
