:1 I ! I ! I ! I I I I I I I I I I I I § 7.14 Pawnbrokers 7.13.02 General. S~bdivision. 1. Purpose. The Council finds that pawnbrokers potentially provide an opportunity for the commission of crimes and their concealment because such businesses have ~e ability to receive and transfer stolen property easily and quickly. The Council also f'mds that consumer protection regulation is warranted in transactions involving pawnbrokers. The purpose of Wis Section is therefore to prevent pawnbroking from being used as facilities for commission of c~imes and to assure that such businesses comply with basic consumer protection standards, thereb~ protecting the public health, safety, andgeneral welfare of the citizens of the City. SUbd. 2. License Required. No person, partnership, or corporation shall engage in or carty~ on the business of a Pawnbroker or Secondhand Goods Dealer, without a license issued by the City, for each and every separate office or place of business operated by such licensee in the CIO/. The annual fee for such license shall be set by Council resolution. A l~icense under this Section shall authorize the Iicensee to carry on its business only at the permanent place of business designated in the license. No license may be transferred to a different location bra different licensee. Subd. 3. License Limitation. No more than three pawnbroker licensed businesses shall be permitted by the City at any one time. Priority shall be given to qualified applicants for renewal of existing licenses. 7.13.03 Ai~plication procedure and Investigation. Subdivision 1. Filing of Application. Every applicant for a license to maintain, operatelor conduct a Pawnbroker shop or Secondhand Goods Dealer shop shall file a completed application under oath with the City upon a form provided by the Administrator and pay a non-refundable gpplication fee in an amount set by Council resolution and the investigation fee described below. ~he application, once accepted, shall be referred to the City Police Department for investigation, iCopies of this application shall be forwarded to such other City departments as the Council shall ~eem appropriate for investigation of the facts set forth in the application. The Chief of Police a~d such other department heads shall make a written recommendation to the Council as to the igsuance or non-issuance of the license. Subd. 2. Contents of Application. The completed application form shall contain all information indicated on said form, including: a. Name, place of birth, date of birth, and street residence of the applicant. b. The business address and the name and address of the owner of #he proposed licensed premises, and the exact legal description of the licensed premises. c. A statement as to whether, within the preceding five years, the applicant has been convicted of any law relating to theft, damage or trespass to property, sale of a controlled substance,'or the operation of a business; the nature of any such offense and the penalty assessed. d. Whether the applicant is a natural person, corporation or partnership. i. If the applicant is a corporation, the state of the incorporation and the names and addresses of all officers and directors. The Application shall be accompanied by the Articles of Incorporation and Secretary of State's Certificate of good standing of the
