Purpose. The Council finds that pawnbrokers potentially <br />provide an opportunity for the commission of crimes and their concealment because such <br />businesses have ~e ability to receive and transfer stolen property easily and quickly. The Council <br />also f'mds that consumer protection regulation is warranted in transactions involving pawnbrokers. <br />The purpose of Wis Section is therefore to prevent pawnbroking from being used as facilities for <br />commission of c~imes and to assure that such businesses comply with basic consumer protection <br />standards, thereb~ protecting the public health, safety, andgeneral welfare of the citizens of the <br />City. <br /> SUbd. 2. License Required. No person, partnership, or corporation shall <br />engage in or carty~ on the business of a Pawnbroker or Secondhand Goods Dealer, without a <br />license issued by the City, for each and every separate office or place of business operated by such <br />licensee in the CIO/. The annual fee for such license shall be set by Council resolution. <br /> A l~icense under this Section shall authorize the Iicensee to carry on its business only <br />at the permanent place of business designated in the license. No license may be transferred to a <br />different location bra different licensee. <br /> <br /> Subd. 3. License Limitation. No more than three pawnbroker licensed <br />businesses shall be permitted by the City at any one time. Priority shall be given to qualified <br />applicants for renewal of existing licenses. <br /> <br />7.13.03 Ai~plication procedure and Investigation. <br /> Subdivision 1. Filing of Application. Every applicant for a license to <br />maintain, operatelor conduct a Pawnbroker shop or Secondhand Goods Dealer shop shall file a <br />completed application under oath with the City upon a form provided by the Administrator and pay <br />a non-refundable gpplication fee in an amount set by Council resolution and the investigation fee <br />described below. ~he application, once accepted, shall be referred to the City Police Department <br />for investigation, iCopies of this application shall be forwarded to such other City departments as <br />the Council shall ~eem appropriate for investigation of the facts set forth in the application. The <br />Chief of Police a~d such other department heads shall make a written recommendation to the <br />Council as to the igsuance or non-issuance of the license. <br /> <br /> Subd. 2. Contents of Application. The completed application form shall <br />contain all information indicated on said form, including: <br /> <br /> a. Name, place of birth, date of birth, and street residence of the applicant. <br /> <br /> b. The business address and the name and address of the owner of #he <br /> proposed licensed premises, and the exact legal description of the <br /> licensed premises. <br /> <br /> c. A statement as to whether, within the preceding five years, the applicant <br /> has been convicted of any law relating to theft, damage or trespass to <br /> property, sale of a controlled substance,'or the operation of a business; <br /> the nature of any such offense and the penalty assessed. <br /> <br /> d. Whether the applicant is a natural person, corporation or partnership. <br /> i. If the applicant is a corporation, the state of the incorporation and <br /> the names and addresses of all officers and directors. The <br /> Application shall be accompanied by the Articles of Incorporation <br /> and Secretary of State's Certificate of good standing of the <br /> <br /> <br />
