Case #3: R~quest for Sketch Plan Review of Putter's Field, a Minor Subdivision; Case of Rich Kerner This case was reolocncd upon request by the applicant to address concerns he had regarding thc Staff Review lettei: dated February 1, 1995. Applicant Rich Ketner inquired about the dedication of thc drainage and utility easements. Zoning Administrator Frolik stated that Mr. Kerner should give this information to his surveyor so that the standard dritinage and utility easements can be added to the final plat. Mr. Kerner stated that his wetlands have been filled previously, and he inquired as to whether he could remove some) of the fill to improve the area. City Engineer Jankowsld advised that he can remove fill and deposit it on high ground or off-site. Commissioner Deemer also advised that he is allowed to fill up to 400 square feet of wetland. Chairperson Bawden recessed the meeting at 8:55 p.m. Chairperson Bawden called the meeting back to order at 9:05 p.m. Case #5: Request to Renew a Conditional Use Permit for an Asphalt ProdUction Plant; Case of Commercial Asphalt Zoning AdministratOr Frolik stated that Commercial Asphalt has submitted an application for the issuance of a new cofiditional use permit (CUP) to continue the operation of a hot mix asphalt plant which was gu'st issu~l by a CUP on July 12, 1988. She reported the applicant has indicated that the operations are intended to be status quo as they have been since 1988. Brent Schlueter, Facilities Planning and Compliance Coordinator for Commercial Asphalt, . addressed proposed indings of Fact #15 and advised that they own the south 30 feet of Lot 2 Block 4 and therefor~ have fee utle access to Basalt Street. He also referenced Term g4 of the proposed CUP, stating that they have been permitted a maximum height of 35 feet for stock piles of material and would like to retain that height limit, not the 32 which is proposed. Mr. Schlueter also noted they would agree to providing a performance bond as outlined in Term #13. Commissioner Deemer suggested there be a requirement for crushing demolition concrete and asphalt at least once a year, as required of a similar operation in Ramsey, Bury and Carlson. Commissioner Hendriksen inquired as to the list of properties notified for the public hearing on this matter, and Ms. Fr01ik distributed the list for the Commission's review. Chairperson Bawden inquired whether the applicant had a chance to discuss the odor problem with the resident who spoke at the public hearing. Mr. Schleuter replied that he had discussed it with the resident, Mr. Hamilton, and has asked to be contacted immediately ~hen the problem occurs in the future in order to determine what is causing the odor and try to remedy the situation.
