The DEVELOPER agrees to pay the entire amount owed in <br />full within thirty (30) days of written request by the CITY. <br /> <br />In the e~ent the final trunk costs result in the DEVELOPER having a negative amount <br />owed to~e CITY, the CITY will remit the amount owed to the DEVELOPER within <br />thirty (3(]) days of the final costs being certified by the City Council. <br /> <br />II. <br /> <br /> STAG:E II IMPROVEMENTS AND FINANCIAL GUARANTEES: <br /> <br /> Street C caning, From time to time, the CITY may remove accumulations of soil, earth <br /> and debt s from the streets resulting from the construction of the Plat. It shall be the <br /> DEVEL ~PER'S responsibility to pay the costs associated with this necessary street <br /> cleaning. Invoices from the CITY to DEVELOPER for such costs shall be paid within <br /> fifteen (E ;) days of the date of invoice. <br /> <br /> S,tr.eet/T{affic Signs, Street Lights, Street Cleaning and Seal (~oating~ The <br /> CITY will install in the Plat, as Stage II Improvements, street/traffic signs and sealcoating. <br /> The DEVELOPER will pay to the CITY as amount equal to 100% of the City Engineer's <br /> ' i <br />esnmatedl construction cost of the items prior to recording of the final Plat. Hard surfaced driveways are a requirement for each lot in <br />the Plat. ~taid improvement shall be installed by the building permit applicant or the <br />homeowner at the time the Certificate of Occupancy is issued or as soon thereafter as <br />possible, ~eather permitting. In the event this improvement is not timely installed, the <br />DEVELOffER, on behalf of all subsequent owners of lots within the Plat, agrees that the <br />CITY ma~ install said improvement on any lot and specially assess its cost therefore <br />against the lot. The DEVELOPER hereby waives all fight to a public hearing and other <br />statutory rights or City Charter fights granted a property owner relating to special <br />assessmentS, including the right to appeal the special assessment for installation of the <br />improvemeSt described in this paragraph. In addition, the DEVELOPER grants the fight <br />to the CIT~ to enter on each lot of the Plat in order to install the improvement described in <br />this paragraph, in the event it is necessary for the CITY to install this improvement and <br />specially as~ess the same. <br /> <br />Trail Coni~truction, The DEVELOPER shall construct and pave in accordance with <br />CITY stand,ds, a ten (10) foot wide bituminous trail not to exceed 5% in grade, parallel <br />to T.H. #47;, along the entirety of the plat.
