15. <br /> <br />between the edge of the trail pavement and the adjacent property lines. The screening berm <br />Shall be a minimum of seven (7) feet above trail surface and shall be forested. The <br />DEVELOPER shall provide approved turf establishment in conjunction with trail <br />Construction within the subject plat. The DEVELOPER herein agrees that the trail <br />¢onstruction shall not be considered park dedication credit eligible. <br /> <br />III. <br /> <br /> PERMITS, OCCUPANCY AND PROPERTY VALUES: <br />:: <br /> <br />~Requirements for Occupancy Permits. No occupancy permit for any lot in the Plat <br />~shall be issued until (a) vehicular access to the lot is provided including the installation of <br />Class V material on all streets in the Plat; Co) site plan approval is granted by the CITY and <br />any additional expense incurred in giving site plan approval has been reimbursed to the <br />CITY; (c) a Certificate of Survey, including that information required by the CITY, has <br />been supplied to the City Building Official; (d) a tree planting has been accomplished in <br />accordance Mth Item #17 of this Agreement; and (e) all the financial guarantees required by <br />the CITY have been satisfied. <br /> <br />16. :: Develovment of Certain Lots. Lots 1 through 5 of Block 1 are considered riparian to <br /> : Wetland #2-114P and all sumctures, including decks, are subject to a 50 foot setback from <br /> :' the Ordinary High Water Mark. Compliance with this requirement will restrict the style of <br /> home that can be built on these lots, especially on Lots 2 and 3. <br /> <br />i7. Requiremen.t8 for Plumbing. As a part of the plumbing requirements, backflow <br /> preventers shall be installed in each sewer line. ' ' <br /> <br />18. <br /> <br />IV. <br /> <br /> PARK DEDICATION: <br />.Cash .Contributjo.n, The Plat is located in the Oxbow Park District. The <br />DEVELOPER agrees to a cash park dedication requirement in the amount of Eight <br />Hundred Dollars ($800.00) per lot or Twenty Seven Thousand Two Hundred Dollars and <br />no/cents ($27,200.00). <br /> <br />GENERAL <br /> <br />Tree and Sod planting Plan. Sodded boulevards are a requirement for each lot in the <br />Plat prior to issuance of a Certificate of Occupancy. In accordance with City Code and the <br />policy established by the City of Ramsey Park and Recreation Commission on June 10, <br />~993, the DEVELOPER is required to submit a Landscape Plan for CITY approval that <br />identifies existing tree growth within the Plat that will be preserved during conswacfion <br />and new plantings.
