In the event the weather is not conducive <br /> to tree or sod planting at the time of Certificate of Occupancy, the Building Permit <br /> holder shall place a cash deposit in the amount of $200.00 for trees and $100.00 for <br /> stir in an escrow account with the CITY and upon verification of the planting <br /> b~ing accomplished, said cash deposit shall be refunded to the Building Permit <br /> h61der. Failure of the Builder to comply with the planting requirement within a <br /> rehsonable time frame following a determination by the CITY that weather <br /> cdndidons are conducive to planting shall give the CITY authority to cause the <br /> plating, the cost of wMch shall be charged to the escrow account and the Builder <br /> sh~ not be eligible for a refund of the cash deposit made for this purpose. <br /> <br /> Tree Difiease Prevention and Disposal. The DEVELOPER shall prevent the <br /> introducfi~)n and spread of tree disease into the residual tree populations of the Plat and <br /> adjoining Oroperties and reduce the impacts of construction on the residual property of the <br /> Plat and a~l_ joining properties. The DEVELOPER in order to accomplish in acgordance <br /> with "Protecting Trees From Construction Damage" (attached hereto as Exhibit 'A'), shall: <br /> Install phY~Sical barriers, such as sn6w fence, around trees that are to remain. The fencing <br /> shall be l~ated at the dripline of these remaining trees. <br /> Insure tha~ all equipment operators will have readily available, a tree wound dressing and <br /> will apply ~t immediately to damaged oak trees if wounding occurs from April 15 through <br /> July 15. [ . . <br />Insure thatltrees will only be skidded against other trees that are to be removed. Trees in <br />the middleitwenty (20) feet of a road easement will be removed fa'st, with remaining trees <br />to be skidd~l toward the middle of' the road easement. This same procedure will apply to <br />building si~s. <br />Mature tre~s, especially oak and elm, adjoining an easement so that roots enter the <br />disturbed cpnstmction area shall first be severed by a vibratory plow to prevent shattering, <br />scraping ~ exposure of roots of high value trees on adjoining property. <br />Recognize~t trees of value, suitable for tree spade removal that would otherwise be <br />destroyed, .t~hall be identified with ribbon and offered to the CITY at least five (5) days <br />prior to destruction. <br />Tree wood i'emoved during constructiOn, road building and sewer/water installation shall <br />be buried, burned, chipped or hauled to a licensed wood disposal site. Wood waste <br />disposal m~t take into account tree disease control, especially for oak wilt and Dutch Elm <br />disease. Th~ tree inspector needs to make a site inspection to ascertain tree disease hazard <br />prior to con~tmction in order to minimize impact on trees adjoining easement, (including <br />root damagOr and grade changes) and for disease control. An inspectibn to reduce or abate <br />wood wasteidisposal must also manage air quality impact and smoke nuisance to adjoining <br />property owners as well as f'ue safety concerns. <br />Whole trees, may not be disposed of by burning. Trunks and limbs larger than six (6) <br />inches in diameter must be salvaged for lumber, firewood, chipped or hauled to a licensed <br />wood disposal site. Application may be made for an open burning penrdt to dispose of <br />brush less tllan six (6) inches in diameter and stumps with less than four feet of main <br />trunks attac/~ed. The location of the proposed open bum site will be specified by the City <br />Engineer, Efivironmental Specialist and Fire Chief. Wood disposal by burning requires <br />whole tree 6olume reduction, proposed site inspection prior to clearing and an open <br />burning pemai~ 't. Residual ash and unburned stumpage may be buffed on the site at the <br />direction of ~e City Engineer. Chipped material may be applied and utilized on site to <br />mitigate rootidamage from grade changes of the easement or right-of-way and for erosion <br />control and top soil restoration. <br /> <br /> <br />
