Case #4: ~ Report of Section #22 Drainage City Engineer~ Jankowski stated that in 1994, a drainage issue in Section #22, was brought to Council's attention by Mr. Terry Hendriksen. He stated that Council directed him (Jankowski) t~ pursue a solution to the problem. He summarized his actions as follows: First he arranl~ed to have the culvert on 156th Avenue N.W., east of Ramsey Boulevard N.W., lowere41 to facilitate better drainage at the Iow-lying area north of this roadway. Second he had!surveyors stake the best location for the construction of a ditch connecting a series of existilag culverts to provide drainage throughout the area. Mr. Jankowski reported that the third,~action he has taken was to apply for environmental permits for the construction of the proposed ditch system. The Anoka Conservation District responded with that the p~oposed ditch project may cause wetlands peripheral to Wetland #656 to disappear because the improved drainage would eliminate short-term flooding on which the existence of tl~se marginal wetlands are dependent. This would be a violation of the Wetland Conse~rvation Act. He applied for an exemption to the Act based on the fact that the City Council authorized this project during an allowable window prior to the Act going into effect. Thls exemption was approved by the Lower Rum River Water Management Organization; l~owever, this exemption limits the project to the scope of what had been approved in 191~9, which would not include full scale ditching. Mr. Jankowski stated that he has taken advantage of the winter conditions to physically view the drainage system between 156th Avenue N.W. and County Road #5 which is difficult to access and view during most of the year. He recommended the following actions: 1) Lower Mr. Rychly's private drive culvert to an elevation of 868.3 (approximately six inches); 2) Remove 150' high area south c}f Rychly's private drive; 3) Remove filled areas on Welch property south of 153/155. Pl~e culvert to allow Mr. Welch access to highland to the east; 4) Place culvert from wetland into southern end of Lewis pond; 5) Place culvert through berm between Lewis' !east and west ponds; and 6) Clean out ends of culvert on 157th Lane N.W. He estimated that the work described, performed in winter conditions would amount to approximately. $8,000. Permission would have to be obtained from three property owners, two of wbich he has received verbal consent. He requested authorization to obtain drainage easemerlts at the value of $1,000 per acre. All previous and future costs incurred on this project would be proposed to be levied against the Rum River drainage district. Mayor Hardin inquired if the $8,000 Mr. Jankowski quoted included the $1,000 each for the three easements. Mr. Jankowski replied that it would be a little less than $3,000 for the easements but that it is not included in ~e $8,000. Mayor Hardin inquired how this project would be paid for. Mr. Jankowski replied that it would be assessed to the Lower Rum River Water Drainage District. City Attorney Goodrich stated that the assessment would have to be handled under State Statute Chapter 44~.
