PUBLIC HEARING <br />PLANNING- COMMISSION <br />CITY OF RAMSEY <br /> ANOKA COUNTY <br /> STATE OF MINNESOTA <br /> <br />The Ramsey Planning Commission reconvened a public hearing on Tuesday, April 4, 1995 at the <br />Ramsey Municipal Renter, 15153 Nowthen Boulevard N.W., Ramsey, Minnesota to hear further <br />input regarding a request for a conditional use permit (CUP) for a group foster care home; case of <br />Patrick McLafferty. i <br /> <br />Members Present: <br /> <br />Chairperson David Bawden <br />Commissioner Benjamin Deemer <br />Commissioner Terry Hcndriksen <br />Commissioner Paul Holland <br />Commissioner Charles LaDue <br />Commissioner Michael Terry <br />Commissioner Bradley Thomd <br /> <br />Also Present: : <br />CALL TO ORDER <br /> <br />City Engineer Steven Jankowski <br />Zoning Administrator Sylvia Frolik <br />Attorney Gerry Randall <br /> <br />Chairperson Bawden reconvened the public hearing at 7:35 p.m. <br /> <br />PRESENTATION <br /> <br />Zoning Adminisn'at~r Frolik reported that, prior to the Planning Commission's March meeting, <br />City Staff had met With City Attorney Goodrich concerning this subject and its relationship to <br />MS462.357, Subdivisions 7 and 8. It was Mr. Goodrich's opinion that a State-licensed residential <br />facility serving fro~a 7 to 16 persons is not exempted from the local R-1 Residential zoning <br />regulations; such a f~tcility is more appropriately located in a multi-family use district. It was also <br />his opinion that to p~rmit locating a multi-family use or facility serving 7 to 16 persons in an R-1 <br />zoning district in eff'g~gt rezones that property to multi-family, and thus becomes a matter of spot <br />zoning which is in,appropriate. Therefore, it was Mr. Goodrich's advice and City StaWs <br />recommendation thall the present application be rejected because it is a multi-family use in the City's <br />R-1 zone and it doe~ not have a state law exemption per either Subdivision 7 or 8 of MS462.357. <br />However, when the,~3/larch Planning Commission meeting was called to order, Mr. McLafferty <br />insisted that the pull, it hearing be opened despite City Attorney Goodrich's advice to reject the <br />application. Hence, ~he Planning Commission proceeded to conduct the public hearing which was <br />recessed until tonig.ht, in order to obtain further input from those who were informed that the <br />public hearing was not going to be held because of Mr. Goodrich's advice to reject the application. <br /> <br />CITIZEN INPUT <br /> <br />Cai Henderson, 7310 155th Avenue N.W. - stated that this was being dealt with on the wrong <br />level. He felt this i8 a matter of crime and the public's right to know and right to safety. Mr. <br />Henderson commen~ed that Mr. McLafferty stated he was licensed by the Volunteers of America <br />but neglected to sa~he is also licensed by the Department of Corrections. Although he has no <br />choice about McL~fferty being licensed for six boys, Mr. Henderson vehemently opposed <br />increasing that limit to eight. Mr. Henderson noted that McLafferty stated both the City of Ramsey <br />and Anoka County Were informed of the home, yet as of 3/31/95 the Director of Corrections of <br /> <br /> Ptiblic Hearing/Planning Commission/April 4, 1995 <br /> Page 1 of 4 <br /> <br /> <br />
