The City completed major comprehensive plan amendments in 1980, 1988, 1990 and 1993, and is <br />currently in the process of amending the land use/transportation/parks & trails elements of the <br />Comprehensive Plan. These intensive projects over the last 15 years have caused the City to <br />revie~ land use, transportation and urban versus rural development. Consequently, there does not <br />seem to be justification for an interim ordinance for planning purposes at this time. In addition, <br />courts}have said that cities have the right to implement moratoriums, but in doing so are also liable <br />for lo~s of use of property, similar to that which occurred with the interim adult use ordinance <br />whic~cost the City $9,500 plus over $100,000 in legal fees. <br /> <br />Thc City is charged with planning for the highest and best use of property and providing for <br />services in a cost efficient manner. The development of Fox Knoll with sewer and water helps <br />fund trunk extensions that have to go north and west. In addition, it would be difficult for the City <br />to continue to meet the needs of existing residents if the City scaled back urban development in <br />areas Set aside for these densities. Figures E and F of Mr. Gromberg's memo represent the <br />revenue projections for the development of single family units at rural and urban densities based on <br />the amount of land proposed to be reserved for such development in the most recent version of the <br />City Council's preferred comprehensive plan update at this point in time. If the City developed that <br />781 acres slated for single family residential at rural standards, the estimated tax revenue to the City <br />is $138,946.74. If that same acreage is developed at urban standards, the tax revenue to the City <br />would be approximately $1,043,811.92. Curtailing urban development also puts pressure on <br />owners of property in the rural areas to develop and the cost to provide services increases with the <br />large,~Sprawling tots. <br /> <br /> RecOmmendation: <br /> <br />Legally, the City cannot deny a preliminary plat that meets the requirements of the subdivision <br />regulations, and Fox Knoll does so.
