DEVELOPMENT AGREEMENT.- DELLWOOD HILLS <br /> <br />the amount of Nine Thousand Four Hundred-Thirty-four and <br />00/100 Dollars ($9,434.00)'which is the City Engineer's <br />estimate of the benefit-Lots 1 and 9 of the Plat would <br />receive from the improvement of Bison Street N.W. The <br />CITY agrees that it will not further assess any of the <br />lots in the Plat for he hard surface improvement of Bison <br />Street N.W. The said $9,434.00 wilt be deposited with <br />the CITY prior to recording of the final Plat. <br /> <br />Additional Street Easement and Setback Requirement on <br /> <br /> Lots 6 and 7. The DEVELOPER 'agrees to convey by deed an <br /> easement for street purposes over and across that portion <br /> of Lot 6, Block'l, shown as drainage and utility easement <br />'on the Plat. Said conveyance will be provided to the <br /> CITY within ten (10) days after recording of the Final <br /> Plat. Any structure built on either Lots 6 and 7, Lot <br /> 1 of the Plat shall comply with the CITY'S structure <br /> setbacks required of similar City streets. <br /> <br />Variance as to 1?1st Lane NW. The CITY has granted a <br />variance to the cul-de-sac length of 171st Lane NW, which <br />variance permits said 171st Lane NW to be constructed in <br />that length as shown on the plans referenced in Paragraph <br />2 herein. <br /> <br /> I <br /> I <br /> I <br />I <br />I <br />I <br /> <br />I <br /> <br />I <br /> <br />17. <br /> <br />18. <br /> <br />Tree Disease Prevention. .The DEVELOPER shall prevent the <br />introduction and spread of tree diseaseinto the residue <br />tree populations of the Plat and adjoining properties and <br />reduce the impacts of construction on. the residual <br />property of the Plat and adjoining properties. The <br />· DEVELOPER in order to acComplish this shall: <br /> <br />Install physical barriers such as snow fence or <br />string with ribbon, etc. around trees that are to <br />remain (the fencing will be at least ten feet (10') <br />from these remaining trees); <br /> <br />Insure that all equipment operators will have <br />readily available tree wound dressing and will apply <br />immediately to damaged trees if wounding occurs; <br /> <br />Insure that trees will only be skidded against other <br />trees that are to be removed. Trees in the middle <br />twenty feet (20') of road easement will be removed <br />first, with remaining trees to be skidded toward the <br />middle of the road easement. <br /> <br />Dumping of Garbage.
