NOTE CITY COUNCIL MEETING MINUTES <br /> <br />The Planning Commission noted the following City Council meeting minutes: <br /> <br />1) City Council public hearing and regular meeting minutes dated February 14, 1995. <br />2) :City Council regular meeting minutes dated February 28, 1995. <br /> <br />3) City Council regular meeting minutes dated March 14, 1995. <br /> <br />PUBLIC HEARINGS <br /> <br />Chairperson Bawden adjourned the regular Planning Commission meeting at 7:35 p.m. in order to <br />conduct the following public hearings: <br /> <br />1) Request for a Conditional Use Permit for a Group Foster Care Home; Case of Patrick <br /> McLafferty (reconvening) <br /> <br />2) Request to Rezone Certain Property from B-1 Business to B-2 Business; Case of Polka <br /> Dot Dairy and Wayne Johnson, Rum River Properties <br /> <br />3) ~Request to Rezone Certain Property from B-3 Highway Business to R-1 Urban <br /> ~Residential; Case of Super Bowl, Inc. and Fitzsimonds Builders, Inc. <br /> <br />4) !:Request for Preliminary Plat Approval of Fox Knoll; Case of Rick Murray, Residential <br /> ~Development Company, and Mark Kteckner, Fox Development Co. <br /> ? <br />Chairperson Bawden called the regular Planning Commission meeting back to order at 8:50 p.m. <br /> <br />COMMISSION BUSINESS <br /> <br />Case #1: Request for Conditional Use Permit for a Group Foster Care Home; <br /> ~ Case of Patrick McLafferty <br /> ? <br />Zoning Administrator Frolik recounted that when the March Planning Commission meeting was <br />called ~o order, Mr. McLafferty insisted that the public hearing be opened despite City Attorney <br />Goodrichfs advice to re.~ect the application. Hence, the Planning Commission conducted the public <br />hearing which was reconvened and adjourned earlier tonight. Therefore, it is Mr. Goodrich's <br />advice:that because the public hearing was conducted, it in effect initiated the conditional use permit <br />(CUP,process, and based on that, he advises the Planning Commission to continue considering <br />this matter from a zoning perspective, adopt findings of fact, and make their recommendation to the <br />City COuncil. <br /> <br />Mr. Gerry Randall, of Randalt, Dehn & Goodrich, suggested that the Commission consider <br />amending the findings of fact to reflect that permitting this use is not in harmony with the City <br />Comprehensive Plan. <br /> <br />The planning Commission proceeded to review the findings of fact. <br />It waste consensus of the Planning Commission to accept #1 through #10 as presented. <br /> <br />Planning Commission/April 4, 1995 <br /> Page 2 of 9 <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
