I <br /> I <br />;I <br /> I <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Deemer to amend #11 to read <br />"That permitting a t~ulti-family use in a single family residential zone is not consistent with the <br />intent and purposei~ of the City's Zoning Chapter, and it is not in harmony with the City's <br />Comprehensive Plan." <br /> <br />Motion carded, voting Yes: Chairperson Bawden, Commissioners LaDue, Deemer, Holland, <br />Terry, and Thorud. ,Voting No: None. Abstain: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to amend #12 to read <br />"That the City has riot permitted other multi-family uses in a single family residential zone since <br />1976, and that ther~ are no provisions in the City ordinances for multi-family uses without city <br />sewer and water." <br /> <br />Motion carded, voting Yes: Chairperson Bawden, Commissioners Deemer, Thorud, Holland, <br />LaDue, and Terry. ¥oting No: None. Abstain: Commissioner Hendriksen. <br /> <br />Motion by CommisSioner Deemer and seconded by Commissioner Terry to add a finding to read <br />"That the proposed Ose will require additional City services by reason that there will be an increase <br />in police calls due tO the nature of the use." <br /> <br />Further Discussion:i Commissioner Holland stated that he heard no mention that there have been <br />any police calls toldate. Commissioner Deemer replied that Mr. Cai Henderson submitted <br />information at the ptlblic hearing regarding police calls to this residence. Attorney Randall stressed <br />that there was no ne~l for this scrutiny since this is not a CUP issue, but a rezoning issue. <br /> <br />Motion failed, voting Yes: Commissioner Terry. Voting No: Chairperson Bawden, <br />Commissioners Dee~er, Holland, LaDue, and Thorud. Abstain: Commissioner Hendriksen. <br />Motion by CommisSioner Holland and seconded by Commissioner LaDue to recommend that City <br />Council adopt the !amended findings of fact relating to Patrick McLafferty's request for a <br />conditional use per~ it for a group foster home to accommodate eight (8) youth in a single family <br />residential district. <br /> <br />Motion carded, vO~ting Yes: Chairperson Bawden, Commissioners Holland, LaDue, Deemer, <br />Terry, and Thorud. ¥oting No: None. Abstain: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council deny Patrick McLafferty's request for a conditional use permit based on negative findings <br />of fact. <br /> <br />Further Discussion:i It was the consensus of the Planning Commission that this is a rezoning <br />issue, and therefore ~onsidered the request to be spot zoning. <br /> <br />Motion carried. Vt/ting Yes: Chairperson Bawden, Commissioners Deemer, Holland, LaDue, <br />Terry, and Thorud. Yoting No: None. Abstain: Commissioner Hendriksen. <br /> <br />Case #2: <br /> <br />Reqqest to Rezone Certain Property from B-1 Business to B-2 <br />Business; Case of Polka Dot Dairy and Wayne Johnson, Rum River <br />Properties <br /> <br />Zoning Administra!or Frolik reported that Polka Dot Dairy and Rum River Properties are <br />requesting to rezoneiproperty at the northwest corner of the intersection of T.H. #47 and C.S.A.H. <br />#116 from B-1 BuSiness to B-2 Business to facilitate development of the property with a <br />convenience store with gas. <br /> <br />Planning Commission/April 4, 1995 <br /> Page 3 of 9 <br /> <br /> <br />
