which case the request may be made any time, without prior notice, <br />during the evaluation or treatment period and for a period of up to <br />two years thereafter. <br /> <br />Refusal to agree to a test or sign the consent form under this Policy <br />is insubordination and grounds for disciplinary action, up to and <br />including termination. <br /> <br />Discipline <br /> <br />In each case, appropriate disciplinary action for possession, use, or being <br />under the influence of alcohol, controlled substance, or illegal drug will be <br />based upon the circumstances. The nature and severity of the discipline will <br />be determined at the sole discretion of the City. Such disciplinary action <br />may include an oral or written warning, suspension, probation, or <br />termination. <br /> <br />An employee determined to be under the influence of alcohol, controlled <br />substance, or illegal drugs, will not be pennitted to remain on City property. <br />The Supervisor wilt make efforts to seek transportation for the employee to <br />get home safely by offering to call the employee's home, a friend, a person <br />designated by the employee to contact in an emergency, or public <br />u'ansportafion. <br /> <br />Rghabilitat/on <br /> <br />Depending upon the circumstances, the City may, at its option, suspend or <br />modify disciplinary action and require the employee to participate in <br />chemical dependency counseling, rehabilitation, and/or an employee <br />assistance program. An employee who elects such participation may have <br />related disciplinary action suspended while counseling, rehabilitation and/or <br />assistance programs are being utilized. There shall be disciplinary action, <br />which may include termination, for an employee who declines to participate <br />in, or fails to complete, drug/alcohol counseling, rehabilitation, and/or an <br />employee assistance program in lieu of disciplinary action, or for an <br />employee who, having successfully participated in such a program, again <br />engages in conduct prohibited in this policy. <br /> <br />Confident/ali .ty <br /> <br />All information the City gathers under this policy, whether of an employee's <br />medical history, history of drug/alcohol use, arrest, treatment, test results or <br />otherwise, shall be treated with strict confidentiality, and disclosed only on <br />a need-to-know basis.
