Mr. Schroeder replied that the developer originally proposed 14 lots and the City reviewed <br />it and came up with 11 lots. <br /> <br />Mr; Essig stated that they see eight lots and it is not feasible to develop eight lots. He <br />stated that at fn'st Staff suggested that 20 or 30 lots were possible but there is no way. <br /> <br />City Engineer Jankowsld stated that it's Staff position that there are other options. He <br />staied to Mr. Essig, "we feel you have a fairly substantial area and it will serve more than <br />two lots. We feel the plan should be platted for urban". <br /> <br />M~. Essig stated "we feel there are only eight lots and it's not feasible". <br /> <br />Mn'. Jankowski stated that this was just done on Krypton Street N.W. with 12 lots. The <br />City picks up the difference of what they consider trunk and what they consider lateral. <br /> <br />Mr. Essig reiterated that he feels it is not feasible. <br /> <br />Mr. Schroeder stated that the reason for the urban transition zone is to be good stewards to <br />the land and provide for the best use of the land. If Council allows this, it's not following <br />thee intention of the wansition. <br /> <br />Mr. Essig stated that the Planning Commission recommended the plat as presentexL <br /> <br />C°uncilmember Zimmerman inquired if Council could legally mm Mr. Kleckner down. <br /> <br />City Attorney Goodrich stated that he has the right to plat it if he meets all the City's <br />requirements. He suggested that Council could table this case for Ms review. <br /> <br />Mayor Gilbertson felt that he should not be denied approval if he has done the plat <br />according to the way the City asked him to. <br /> <br />Mr. Essig called attention to an overview plan and stated it cost him $1,500 to have it done. <br /> <br />Mayor Oilbertson stated that he does not really agree with the sewer and water part of the <br />plan. <br /> <br />~. Essig stated that their construction season is nearing an enck <br /> <br />Iq[ayor Gilbertson stated that what Fox Development is doing would not be his choice but if <br />~ey are doing as they were told by the City, he feels the City should grant approval, <br /> ? <br />Motion by Councilmember Peterson and seconded by Councilmember Hardin to table this <br />ease until the City Attorney and City Staff has had a chance to review the City Code platting <br />provisions and to schedule a special meeting, ff necessary, to get th~s taken care of. <br /> <br />Further discussion: Councilmember Beyer asked Mr. Essig if he could "live with" <br />Council's direction to which Mr. Essig replied that he is asldng for approval and added that <br />he has been dealing with this since Juty. <br /> <br />Motion carried. Voting Yes: Councilmembers Peterson, Hardin and Zimmerman.
