In accordance with City ordinances (Resolution Ro91-4) and <br />approved policies, the costs of all local or collector streets within or abutting a subdivision <br />is a developmental responsibility. This responsibility is for a standard City design street, to <br />a "7-ton strength standard" and to a maximum width of 36 feet face to face. <br /> <br />The Developer acknowledges that alt properties are responsible for construction of, or <br />contribution toward, the construction of collector streets in the City of Savage. <br /> <br />In conformance with this, the Developer does hereby acknowledge and agree that there is <br />due and owing against lots which comprise the subdivision, a collector street assessment in <br />the amount of $1,302.00' per net developable acre. of land area payable at time of platting, <br />plus ~ fee of $213.00' per residential lot collectable at time of building permit issuance. <br />This assessment is for the purposes of paying the increased costs of added width or <br />structure required for collector streets that serve all developments. This debt shall constitute <br />a lied against said subdivision. <br /> <br />There shall be credited against the collector street assessment mede on the per acre basis <br />all amounts expended under this Developer's Agreement for collector streets required by the <br />City and constructed by the Developer. The amount of such credit shell be determined by <br />one of the following conditions as applicable: <br /> <br />* Current Collector Street Policy rate as of 1/93. Subsequent phases shall use the rate in <br />effect at the time the Developer's Agreement is signed for that phase, <br /> <br />_C~dition 1: Any construction hosts of a standard street with 7-ton desigp strength <br />and a width as required for the Subdivision shall be totally a developmental cost with <br />nd credit provided. This shall be for a street width inclusive of the 32-ft. minimum <br />allowable width and up to the 36-ft. maximum required width along the City approved <br />variances thereto. <br /> <br />_Condition 2: For any required increase in'street strength to a design higher than the <br />7-ton standard, which requirement does not include a width greater than 36.0 feet, <br />the credit against the collector street area assessment shall be determined from a City <br />approved engineer's est[mate or construction bid by calculating the cost of the <br />required strength street and subtracting therefrom the cost of the standard strength <br />street. <br /> <br />Condition 3: For any required increase in street width to a design standard wider than <br />the nominal street width approved for the Subdivision {except as described in <br />Condition 1 herein), the credit against the collector street area assessment shall be <br />determined from a City approved engineer's estimate or construction bid by calculating <br />the cost of the required width street and subtracting therefrom the cost of the 36' <br />width street for the Subdivision. <br /> <br />Condition 4: For any required increase in both street structure and width to strength <br />standard higher than 7-ton, or width standard greater than the nominal street width <br />approved for the Subdivision (except as described on condition 1 herein), the credit <br />against the collector street area assessment shall be determined from a City approved <br />engineer's estimate or contractor's bid by calculating the cost of the required width <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br />I <br />I <br /> <br />I <br /> <br /> I <br />I <br />I <br />I <br />I <br /> <br /> <br />
