r <br />f <br />f <br />' WHEREAS, - ,no expenditure of CITY funds will be made until the City Code escrow <br />requirements have beon completed by the DEVELOPER. <br />NOW THEREFORE, the CITY and DEVELOPER agree as follows: <br />It <br />I <br />STAGE I1 IMPROVEMENTS AND FINANCIAL GUARANTEES: <br />1. City Code 6mnliance. That the DEVELOPER will develop the Plat in accordance <br />with the City Lode, Section 9.50, entitled "Subdivision. <br />2. Conformance with Plan. The Plat shall be developed pursuant to the final plat <br />consisting of qne (1) sheet, prepared by Caine & Associates Land Surveyors, Inc., entitled <br />f <br />Sunfish Square 2nd Addition. <br />E <br />3. Incornoratidp of All Cit Code Requirements. That the recitals above and the <br />provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br />Code of the CITY, as amended to date hereof, are incorporated herein by reference. <br />4. Stage I Imirovements Rcquired. The DEVELOPER agrees to construct the <br />required Stag ' I Improvements according to the terms and conditions of this contract and in <br />accordance w th DEVELOPERS' plans submitted to the CITY. Said plans shall be in <br />general conformance with the Grading and Drainage Plan prepared by Kenneth J. Gust and <br />dated Septerriber 17, 1993, revision dates 12 -9 -93, 2 -10 -94 and 4 -11 -95 and final <br />construction �lan for sanitary sewer, storm sewer, watermain, and street improvements <br />dated March9, 1995 with modifications as directed by the City Engineer. The <br />DEVELOPE� shall also be responsible, at its expense, for installation of gas, telephone, <br />and electric ut#ity improvements. Street lights are the responsibility of the DEVELOPER, <br />however, the [CITY will arrange for their installation as a Stage H Improvement. The <br />DEVELOPE� shall be responsible for completing the rough grading and providing lot <br />corner stakes prior to the installation of underground utilities. <br />5. Bituminous �Pedestrian Trails— The DEVELOPER shall be responsible for the <br />construction o an eight (8) foot wide bituminous pedestrian trail within the C.S.A.H. #57 <br />right -of -way, [ to C.S.A.H. #57, from the intersection of C.S.A.H. #116 and <br />142nd Lane I.W. north to 143rd Lane N.W.
