construction, as determined by the City Engineer, and presentation of supporting cost <br />documentation, the CITY will credit the sewer and water trunk charges to the Plat in an <br />amount equal to the cost of trail construction beyond the plat boundary. <br />6. Boulevard and Area Restoration. The DEVELOPER shall be responsible for the <br />cost of establishing seed or sod in all boulevards within thirty (30) days of the completion <br />of the street improvements, and restoring all other areas disturbed by the development <br />grading operation in accordance with the approved erosion and sediment control plan. The <br />DEVELOPER shall also be responsible for the cost of cleaning any soil, earth or debris <br />from the wetlands within and adjacent to this Plat resulting from grading performed in the <br />development of the land. <br />7. Requirements After Street Surfacing. After the street surfacing is installed, the <br />DEVELOPERS shall clear any soil, earth, or debris from the streets and from the lots <br />within the Plat resulting from any construction on the Subject Property by the <br />DEVELOPER or their successors and assigns. <br />8. Stage I Improvements Completion Date: The Improvement completion date shall <br />be on or before November 1, 1995. <br />9. Satisfaction of Sewer and Water Trunk Charges The combined sewer and water <br />trunk charge for a residential equivalent is One Thousand Five Hundred and Forty Dollars <br />and no cents ($1,540.00). Thus, the trunk charge for the 34 single family units is Fifty <br />Two Thousand Three Hundred Sixty Dollars and no cents ($52,360.00) <br />The DEVELOPER shall be credited the incremental cost of constructing the 8 foot wide <br />bituminous trail beyond the north plat boundary to 143rd Lane N.W. The DEVELOPER <br />shall also receive credit against the total amount of trunk charges due for the incremental <br />cost of oversizing associated with watermain above an eight inch main and with the costs <br />associated with extending the sanitary sewer to the west side of County Road #57. <br />Any net amount due to the CITY by the DEVELOPER after the above credits are <br />calculated shall be paid within fifteen (15) days of billing. Failure to pay the net amount <br />due within the fifteen (15) days will permit the CITY to draw upon any of the escrows <br />required. Any net amount due the DEVELOPER shall be credited towards the cost of <br />sewer and water trunk charges in subsequent phases of this development. <br />
