Councilmember introduced the following resolution and moved for its adoption: <br />' RESOLUTION #95-06 - <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A <br />' REQUEST FROM NORTH FORK, INC. FOR A CONDITI NAL USE PERMIT <br />TO GRADE ANIl EXPORTS SOILS <br />WHEREAS, the City of Ramsey received an application from North Fork, Inc. for a <br />conditional use permit to grade and export excess soils from the property legally described as <br />follows: <br />' Lots 3 and 4,Block 2, NORTHFORK LAKE ADDITION, Anoka County, Minnesota. <br />(the "Subject[Property ") <br />' NOW THEREF6;RE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAM EY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact Mating to the request are determined to be as follows: <br />' 1. That on Mal' 16, 1995, North Fork, Inc., hereinafter referred to as "Applicant ", has <br />properly app ed for a conditional use permit to grade and export excess soils in Northfork <br />Planned Unit Development District. <br />' 2. That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on June 6, 1995, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />' as a part of these findings by reference. <br />3. That the subjQct property is located in a residential area of a Planned Unit Development and <br />' the proposed Orea for grading is approximately two (2) acres in size. <br />4. That Section 9.11.18 (Grading, Mining and Filling Permits) states that a conditional use <br />' permit shall bye required to grade individual lots by more than 3 feet in depth, fill individual <br />lots by more 'Tthan 2 feet at any point, and excavate more than 400 cubic yards of earth <br />material. <br />5. That the grading plan submitted proposes to regrade the Subject Property to create more <br />attractive building sites. <br />6. That the Applicant is proposing to strip the topsoil on the Subject Property, export <br />approximately 16,000 cubic yards of earth material, and replace the topsoil. <br />7. That the Applicant has stated that the project should have minimal adverse impact on the <br />adjacent residential parcels as exporting of the earth material can be accomplished within a <br />period of four weeks by belly dump truck. <br />8. That the App icant has stated that the proposed haul route consists of travelling west on <br />Inverness Lar e and the westward for a distance of approximately 800 feet, and from there <br />across outlot d golf course to the northern boundary of the Burlington Northern right of <br />way, and ther onto 153rd Avenue N.W., and then southward to U.S. #10. It may also be <br />permissible to place the material on the outlot in accordance with an approved grading plan. <br />9 That no fill rn #terials are proposed to be imported to the site. <br />�S <br />
