I 18. All costs incurred by the City in executing and administering this permit shall be the responsibilit} of the permit holder. The permit holder shall maintain a minimum Five Hundred Dol ar ($500.00) balance in an escrow account with the City. This escrow shall be used to rei nburse the City for expenses incurred in the administration of this permit. At ' the time the nuning operation and site restoration are completed to the satisfaction of the City, the bal ce of the escrow shall be returned to the Per nit Holder. ' 19. The haul rout for the excavated material shall be from the site westward for a distance of approximatell 800 feet, and from there across outlot and golf course to the northern boundary of a Burlington Northern right of way and then onto 153rd Avenue N.W., and then southw4d to U.S. #10. It may also_be permissible to place the material on the outlot ' in accordance with an approved grading plan. 20. All grading operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only ' unless otherwise specifically approved by the City Administrator and/or his designee. 21. The amount §f dust or other particulate matter caused by the mining operation shall not ' exceed the standards dards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceed 30 miles per hour. 22. All operations shall comply with all applicable Minnesota Pollution Control Agency ' regulations and Federal and Environmental Protection Agency regulations for the protection of water quality. 23. All haul roadi are subject to the approval of the City Engineer. While hauling operations ' are in progres , the permit holder shall maintain the haul road in a condition satisfactory to the City Engineer. When hauling operations are completed, the permit holder shall either restore that hhul road to a condition at least equal to that which existed at the time the ' hauling operations were started, or compensate the local road authority in an amount satisfactory td that road authority and concurred in by the City Engineer for the restoration of that haul read. The City Engineer will then accept such restoration or concur in such ' financial settl ment for the restoration of the haul road in writing and such acceptance will relieve the pe 't holder of any additional obligation in connection with the restoration of the haul road . If the permit holder fails or refuses to perform haul road restoration or to make satisfactory financial settlement for such restoration, the City will cause the restoration w rk to be done and require reimbursement from the financial guarantee required here. 23. The motion for ado�tion of the foregoing resolution was duly seconded by Councilmember ' and upon vote being taken thereon, the following voted in favor thereof: and the following vot(id against the same ' and the following abstained and the following werr, absent whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this ' the _ day of 1995. � X19
