a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to <br />one person and $500,000 for one accident, and at least $1,100,000 property damage. <br />b. Said policy shall be for the full period of the permit and shall provide for the giving of <br />10 days prior notice to the City by registered mail of termination, cancellation or <br />amendment of the policy. <br />c. In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this <br />item is obtained and filed with the City prior to the termination of the policy in force. <br />15. The maximum noise level at the perimeter of the worksite shall be within the limits set by <br />the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br />United States. <br />16. All grading operations shall be conducted in accordance with the grading plan dated May, <br />16, 1995 prepared by Gerald Floden, P.E. The proposed area to be graded is roughly two <br />acres in size. Excavation of the entire area shall be permitted. Continuation of grading <br />shall require finished grade areas to be restored wit six (6) inches of topsoil, seed and disc <br />anchored mulch. <br />17. All grading shall be completed within fourteen dpreading alendar days of the commencement of <br />the grading operation. Restoration of the turf a minimum of four (4) inches <br />of topsoil, fertilizer, seed and mulch shall be completed within seven (calendar days of <br />the completion of the grading. �,r <br />r <br />working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br />10. <br />No gradng operation shall be conducted closer than 30 feet to the right of way line of any <br />' <br />existing or platted street, road or right of way. <br />11. <br />Prior to commencing any grading operations, a cash escrow or letter of credit approved as <br />to form by the City in the amount of Five Thousand Dollars ($5,000.00) shall be deposited <br />with the City. This financial guarantee may be used by the City to pay for the cost and <br />expense of repairing any public right of ways or regrading and stabilizing eroded areas due <br />to the grading operation, pay for any cost associated in administering the requirements of <br />this Chapter of the City Code, and to pay for any restoration of the worksite not properly <br />restored upon completion. <br />12. <br />The Permit Folder shall implement sediment and erosion control practices. No grading <br />activity shall occur within twenty -five (25) feet of a property line unless silt fence is placed <br />along the property line to prevent sediment from washing onto the adjoining property. Any <br />erosion which causes gullies of greater than one (1) foot within twenty -five (25) feet of a <br />property line shall be regraded within forty -eight (48) hours of the precipitation event that <br />caused the erosion. <br />13. <br />There shall be no stockpiling of graded materials, other than the topsoil on a tem o <br />basis, allowed within the boundaries of the P.U.D. Topsoil stockpiles shall not exceed <br />900 cubic yards in total nor six (6) feet in height. <br />14. <br />The permit holder shall file with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br />a.
