Councilmember _ introduced the following resolution and moved for its adoption: RESOLUTION NO. 95-06 - A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE ' PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO GRIkDE AND EXPORT SOILS ' WHEREAS, the Ramsey City Council adopted Resolution No. 95 -06- adopting Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the following condition NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1995, a Conditional Use Permit ( "CUP ") was issued by the City of Ramsey ' ( "City ") to North F ork, Inc. ( "Permit Holder ") for grading operations on the property legally described as follows~ Lots 3 and 4� Block 2, NORTH FORK LAKE ADDITION, Anoka County, Minnesota. This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this peanut are as follows: 1. This permit 4hall expire thirty (30) days from the date of commencement of operations and the Permit H lder shall be responsible for providing the City with at least 48 hours advance notice of the to of commencement. 2. All equipme�t used for grading and hauling operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the worksite regularly. 3. All worksitO shall be properly safeguarded to prevent the general public from depositing garbage or otlher refuse on the worksite. 4. Existing tree land groundcover shall be preserved to the extent feasible. 5. Grading operations shall be conducted in such a manner to minimize interference with the surface wateri drainage outside the boundaries of the operation. 6. No grading operations shall occur at below an elevation of 6 feet above the elevation of the water table ofi the worksite. F 1 7. Fencing may ibe ordered by the City Council or City Engineer anytime the permit is in force and shall be i�stalled within 24 hours of written notice. 8. All access rods to and from the Subject Property, shall be maintained in order to minimize dust. 9. The maximurb slope other than the working face shall be sloped on all sides no steeper than a rate of 2 foot horizontal to I foot vertical. In no case shall the slope of the working face be left unattinded with a slope greater than 2 feet horizontal to 1 foot vertical.
