Councilmember _ introduced the following resolution and moved for its adoption: <br />RESOLUTION NO. 95-06 - <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />' PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF <br />PERMIT TO GRIkDE AND EXPORT SOILS <br />' WHEREAS, the Ramsey City Council adopted Resolution No. 95 -06- adopting <br />Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the <br />following condition <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />On , 1995, a Conditional Use Permit ( "CUP ") was issued by the City of Ramsey <br />' ( "City ") to North F ork, Inc. ( "Permit Holder ") for grading operations on the property legally <br />described as follows~ <br />Lots 3 and 4� Block 2, NORTH FORK LAKE ADDITION, Anoka County, Minnesota. <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this peanut are as follows: <br />1. This permit 4hall expire thirty (30) days from the date of commencement of operations and <br />the Permit H lder shall be responsible for providing the City with at least 48 hours advance <br />notice of the to of commencement. <br />2. All equipme�t used for grading and hauling operations shall be maintained and operated in <br />such a manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall <br />be removed from the worksite regularly. <br />3. All worksitO shall be properly safeguarded to prevent the general public from depositing <br />garbage or otlher refuse on the worksite. <br />4. Existing tree land groundcover shall be preserved to the extent feasible. <br />5. Grading operations shall be conducted in such a manner to minimize interference with the <br />surface wateri drainage outside the boundaries of the operation. <br />6. No grading operations shall occur at below an elevation of 6 feet above the elevation of the <br />water table ofi the worksite. <br />F <br />1 <br />7. Fencing may ibe ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be i�stalled within 24 hours of written notice. <br />8. All access rods to and from the Subject Property, shall be maintained in order to minimize <br />dust. <br />9. The maximurb slope other than the working face shall be sloped on all sides no steeper than <br />a rate of 2 foot horizontal to I foot vertical. In no case shall the slope of the working face <br />be left unattinded with a slope greater than 2 feet horizontal to 1 foot vertical.
