' Attorney Goodrich reiterated that Council would have to introduce this in the form of an ordinance. ' Lori Farber, 171 9t Lane in Ramsey, stated she is present to represent the people on 171 st Lane. She is th " representative because her property has the worst of the water run -off problem. She stated that the City had given the Smith's a variance to build their home on a hill and now therle is a storm water run -off problem. She asked who's responsibility it is to ' take care of this oblem - the City's or the Smith's. She stated that the water is backing up into the sewer system and into her basement. The water that's flowing into their drain fields is sewage.' City Administrator Schroeder stated that he and Mr. Jankowski have been trying to get out to view the probl�m since the middle of last week. The issue is "does someone need to dig ' a 300 to 500 fopt ditch or should Mr. Smith be directed to do something ". He had suggested to Msj Farber that there are a number of drainage issues in the City. Staff is planning to com to City Council with all these concerns and to get the list prioritized. He offered to checks. Farber's property and report his findings back to Council. ■ Ms. Farber again asked who's responsibility it would be or is it on a case by case basis. ' Attorney Goodri h stated that it could be the owners, or it could be the responsibility of whomever is cre iting the problem. The City will deal with their responsibility, but this may not be the ty' responsibility either. ' Ms. Farber asked if the City could make Mr. Smith do something about it. Attorney Goodrich replied no, the property owners would have to take care of dealing with ■ that. Mr. Schroeder assured Ms. Farber that Staff would be out to her property this week and would come back to Council with some type of a recommendation. Councilmember ,Zimmerman stated he could name a half dozen new subdivisions with water problems. He felt that there should be something the City can do to hold the developers somewhat responsible for problems such as this. Consensus was t at the Road and Bridge Committee could discuss a vehicle for the City to hold the developers somewhat responsible in issues such as this one. Beth Mitchell, 8 - 176th Lane N.W., Ramsey, announced the date of the Environmental Expo. She state4 that from what she hears, the City Council has decided how to vote on the City's zoning *ith regard to Case #6. Ms. Mitchell was informed that she could speak to Case #6 at the time it is brought up for discussion. APPROVE AGENDA Motion by Councilmember Peterson and seconded by Councilmember Beyer to approve the agenda as presented but to not begin discussion of any new cases after 10:00 p.m. Motion carried.
