CITY OF RAMSEY <br /> <br /> ANOKA COUNTY, MINNESOTA <br /> <br />DEVELOPMENT AGREEMENT - RIVERVIEW BOWL <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF <br />RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and <br />SUPERBOWL, INC., A Minnesota Corporation, whose address is 6720 Riverdale Drive <br />N.W., Ramsey, Minnesota, hereinafter referred to as the "DEVELOPER." <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the City of Ramsey, Anoka County, Minnesota and legally described as follows: <br /> <br /> Lots 1, 2 and 3, Block 1, KIVERVIEW BOW, Anoka County, Minnesota <br />the "Subject Property"; and <br /> <br /> WHEREAS, on July 1t, 1995, pursuant to Resolution 4/95-07-. , the CITY <br />approved the final plat of the Subject Property which plat is known as RIVERVlEW BOWL <br />(the "Plat") contingent on certain requkements, including DEVELOPER and CITY entering into <br />this contract; and <br /> <br /> WHEREAS, the Plat consists of three lots which is a resubdivision of Lot 1, 2, 6 and 7, <br />Block 4, Riverside West; and <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05, entitled "Minor Plat Procedure"; and <br /> <br /> WHEREAS, a trunk usage charge is required by the CITY for usage of its Trunk Sewer <br />and Water System; which charge is $1534.00 per residential unit created; and <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until the City Code escrow <br />requirements have been fulfilled by DEVELOPER. <br /> <br />NOW THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Dedication 9f Drainage and Utility Easements. Drainage and utility easement shall <br />be dedicated to the CITY as shown on the Final Plat. <br /> <br />Trunk and Lateral Sewer anal Water Fees. The DEVELOPER agrees to pay the <br />current One Thousand Five Hundred Thirty Four Dollar and no/cent ($1,534.00) trunk <br />sewer and water charge for each of the two residential lots CLots 2 and 3) in the Plat, as this <br />charge is required of all lots receiving access to the sewer and water system. Therefore, a <br />total of Three Thousand and Sixty Eight Dollars and no/cents ($3,068.00) will be levied <br />against the two residential lots in the Plat resulting from the subdivision, which sum will be <br />due and payable upon the conveyance by deed or contract for deed of either of the said <br />platted lots.
