required tO pay the then current Metropolitan Wastewater Control Commission Sewer <br />Availabilify Charge ("SAC") and the City of Ramsey Water Availability Charge ("WAC"), <br />and any C~ty inspection and installation fee. <br /> <br />Esti.mated~ Costs. It is understood and agreed that construction cost amounts set forth in <br />this Agreement, unless specified as fixed amounts, are estimated. The DEVELOPER <br />agrees to Pay the actual costs, including interest, fiscal engineering and legal charges. <br /> <br /> II. <br />PERMITS, OCCUPANCY, AND USES <br /> <br />ConstruCtion Site .Maintenance. The DEVELOPER shall adhere to all City <br />ordinances relating., to, but not limited to, dumping of garbage, site development, <br />construction debris, open burning, etc. <br /> <br />Require/nents for Building Permits and Certificates of Occupancy, No <br />building ~ermit for any lot in the Plat shall be issued until (a) a Certificate of Survey, <br />including tthat information required by the CITY, has been supplied to the City Building <br />Official; ~d (b) all the f'mancial obligations required by the CITY have been satisfied. No <br />Certificate of Occupancy for any lot in the Plat shall be issued until: (a) a minimum six (6) <br />foot high iprivacy fence has been installed along the north boundary of Lot 2; (b) the <br />CITY'S municipal sewer system is available for service to the lots as determined by the <br />City Engi,heer; (c) the boulevard is sodded and a tree has been planted or a cash deposit <br />has been g~ade in accordance with Item #8 of this Agreement; and (d) the driveway has <br />been hardtmrfaced in accordance with Item ~/9 of this Agreement. <br /> <br />Commeri:ial Uses. The DEVELOPER herein agrees to relocate the outdoor volley ball <br />court on l~ot 1 a sufficient distance north to provide a forty (40) foot buffer between the <br />court and ihe northerly boundary of Lot 2 and that said relocation will be accomplished by <br />June 30, i996'. <br /> <br /> III. <br />PARK DEDICATION <br /> <br />park De. dication. Park dedication shall be satisfied by the DEVELOPER paying to <br />the CITY~ for deposit in its park fund, the sum of Nine Hundred and Sixty Six Dollars and <br />no/centsi($966.00). This amount is derived by attributing the cash paid in 1976 for <br />Riverside!West to the 19.34% Lots 2 and 3 comprise of the original 195,883 square feet <br />and the cgrrent $800/lot requirement. Said sum shall be paid to the CITY prior to the <br />Final Plat[being released for recording. <br /> <br />IV. <br />GENERAL <br /> <br />Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in the <br />Plat prior to issuance of a Certificate of Occupancy. In accordance with the policy <br />establishe4:l by the City of Ramsey Park and Recreation Commission on June 10, 1993, the <br />DEVELOPER shall provide for the planting of one two-inch diameter tree (or equivalent <br />thereof) of an approved species at the road frontage or in the front yard of each of the lots <br />in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is <br />not conducive to tree or sod planting at the time of Certificate of Occupancy, the <br />DEVELOPER shall place a cash deposit in the amount of $200.00 for trees and $100.00 <br />for sod in; an escrow account with the CITY and upon verification of the planting being <br /> <br /> <br />
