I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE # / <br /> <br /> INTRODUCI~ PROPOSED ORDINANCE VACATING A PORTION OF THE <br /> DRAINAGE & UTILITY EASEMENTS ACROSS LOTS 4 AND 5, BLOCK 2, <br /> RIVER'S BLUFF SECOND ADDITION. <br /> By: James Gromberg, Economic Development Coordinator <br /> <br />Background: <br /> <br />The owner of Lotsi4 and 5, Block 2 of River's Bluff 2nd Addition have requested the vacation of <br />the drainage and utility easement that runs along the common property line of the identified lots. <br />This vacation is re4uired to facilitate the proposed home to be constructed on both of the lots. The <br />City Engineer ha.q reviewed the proposed vacation and indicted that there is sufficient area <br />remaining for dmi4age requirements. Enclosed for your review is the following informatiOn: <br /> 1) Public hearing notice <br /> 2) Si~location map <br /> 3) Lisi of properties notified <br /> 4) Mal~ showing area to be vacated <br /> 5) Proir~osed ordinance vacating drainage and utility easements. <br /> <br />If this proposed °~dinance is adopted, the City will record the vacation so that deeds for the <br />affected propertie~, will reflect the vacation. The City will also provide a certified copy of the <br />ordinance to the property owners who are affected by the vacation. <br /> <br />Recommendation: <br /> <br />The City Staff recommends vacation of the drainage and utility easements described as follows: <br /> <br />That portion of a drainage and utility easement lying five feet on both sides of the common <br />lot line between Lot 4 and Lot 5 of Block 2 of River's Bluff subdivision, the center line of <br />said easement being described as follows: <br /> <br />Commencigg at the Southeasterly comer of.Lot 4 Block 2 of River's Bluff 2nd Addition; <br />hence Norhh 57 degrees 41 minutes 46 seconds west along the common property line with <br />Lot 5 Block 2 of said subdivision west to the point of beginning; then north 57 degrees 41 <br />minutes ~ seconds west to a distance of 370 feet + and thence terminating.
