I I I I I Councilmember introduced the following resolution and moved for its adoption: PROPOSED RESOLUTION #95-07- A RESOLUTION APPROVING THE ISSUANCE OF A DWELLING MOVING PERMIT AND DECLARING TERMS OF SAME WHEREA~S, Fred and Jeanette Mertens have properly applied for a Dwelling Moving Permit for the placdment of a modular home on the property legally described as follows: Lot 8, Block 1, PINEVIF. W ESTATES 2ND ADDITION, Anoka County, Minnesota (Subject Property);iand WItEREAS, the Planning Commission met on July 5, 1995, to review the application submittals and rec6,mmended City Council approval of the request. NOW TH]EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAM~SEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. A Dwelling Moving Permit, hereinafter referred to as "Permit", is hereby granted to Fred and Jeanett~. Mertens, hereinafter referred to as "Permittee", for the placement of a modular home, herainafter referred to as "Structure", on Lot 8, Block 1, Pineview Estates 2nd Addition, hbreinafter referred to as "Subject Property". o That the Peimittee shall provide the City with proof of ownership of the Subject Property. That the plOCement of the Su'ucture shall comply with all City Codes and the Permittee shall acquire all necessary permits, local or otherwise, including a building permit. That the Permittee shall be responsible for providing the City with proof that the transporter of the StruCture is licensed to operate in the State of: Minnesota and all necessary permits have been 6btained. That no building permit will be issued for the Smacture to be moved into the City unless the financial gOarantee described in Paragraph 9 has been satisfied. That all plt~mbing shall be tested in accordance with the requirements of the State Plumbing Code. ~ That all electrical circuits shall be tested in accordance with the requirements of the State Electrical 12ode. That the establishment of the Structure on the Subject Property shall be completed and receive certificate of occupancy by December 1, 1995. Failure to complete the project by December 1, 1995, will permit the City to draw upon the financial guarantee required in paragraph ~ of this agreement. That the Parmittee shall provide the City of Ramsey with a financial guarantee in the form of cash or~ a letter of credit, approved as to form by the City, in the amount of Two Thousand Five Hundred DolIars and no cents ($2,500.00) for the purpose of guaranteeing compliance with the terms of this Permit and satisfactory completion of the project, as determine~ by the Building Official.
