I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />! <br />I <br />I <br />I <br /> <br />CASE # 7 <br /> <br />REQUEST FOR rA HOME OCCUPATION PERMIT; CASE OF DIANE DEMPSEY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In the spring of 19~94, Diane Dempsey applied for a home occupation permit to conduct doll <br />making classes in lier new home at 14794 Krypton Court N.W. Because she was the only hOme <br />on the block at thatltime and her future neighbors would not have had the opportunity for input at <br />the public hearing, flue City Council granted her an interim use permit for one year. The consensus <br />was that after a y~r's time, Ms. Dempsey would have neighbors and it would be appropriate for <br />her to relocate to a~ commercial area or re. apply for a permanent home occupation permit. The <br />reapplication wou~d require another public hearing and thus give her new neighbors the <br />opportunity for input. <br /> <br />The following item~ are enclosed for your information: <br /> <br /> a) Site ~oeafion map c) Proposed Findings of Fact <br /> b) Site lplan, floor plan d) Proposed Home Occupation Permit <br /> <br />Notification: <br /> <br />Statutes require n6tificafion of the public hearing to all parcels within 350 feet of the subject <br />property. All homeowners on Krypton Court N.W. were notified of the public hearing. <br /> <br />Observations: <br /> <br />Ms. Dempsey has ibeen conducting classes for almost one year and City Staff has received no <br />complaints regar~ng the home business. Ms. Dempsey indicates that she conducts classes on <br />Monday, Tuesday ~d Wednesday evenings from 7:00 p.m. to 9:30 p.m. and she also conducts a <br />daytime class on ~/ednesdays. She enrolls a maximum of 8 students in each class. Ms. Dempsey <br />can accommodate ~ off-street parking spaces in her driveway and students are encouraged to car <br />pool. She has indicated that on occasion, there may be one car parked in the street but generally, <br />providing for off-sffeet parking has not been a problem. <br /> <br />The Planning Co ~mmission conducted a public hearing on July 5 and there were no verbal or <br />written comments ~ubmiued at the hearing. <br /> <br />Recommendation: <br /> <br />The Planning Co ,mixfission and City Staff recommend approval of the request. <br /> <br /> Council Action: <br /> Moron to: ' ,0f'/ <br /> Adopt ReSOlution g95-O7-k,-/adopting Findings of Fact gL) relating to a request for a <br /> home occupation permit at 14794 ICEepton Court N.W. <br /> <br />CC: <br /> <br />Motion to: i (94~ <br />Adopt Re~lufion ~95-07- ~ , approving the issuance of a home occupation permit at <br />14794 Kry]3ton Court N.W. <br /> <br /> <br />
