NEW BUSIIq'ESS - 5

Elections of Officers

O'Cormell stated that he had included in the packets Article 6 from the
By-Laws which state that any officer may succeed themselves in any
office. The current officers are Gerald Cotten, Chair; Ken Peterson,
Vice-Chair; Vicki Volk, Treasurer; Bruce Johnson, Secretary.

Motion was made by M. Johnson, seconded by Nagel THAT THE
PRESENT POSITIONS WILL BE RENEWED FOR THE NEXT TWO
YEARS.

7 ayes - 0 nay. Motion carried.

Motion was m~de by M. Current officers were reelected

Administrator's Report

O'Connell gave a brief synopsis of the right-of-way bill that was in
front of the State House Legislation. O'Cormell watched on cable the
veto of the McCollum amendment and called both Charlie Weaver
and Teresa' Lynch for a written explanation of why they both voted
against the bill. Lynch responded in writing and Charlie Weaver
return the call and stated his opinions. O'Connell stated to the
Commission that if the cities want control of the right-of-ways, they
have a long 'way to go to convince the legislature. The Bell
representatives have them convinced that the control issue is still
merely a fee that the municipalities are trying to tack on for new
technology.

O'Cormell related part of his conversation with Charlie Weaver.
O'Cormell stated to Mr. Weaver, that the franchise fees are based on the
number of subscribers generate the gross revenues. Most of the
subscribers for the competitive market would probably result from the
'existing universe base and not new subscribers. Mr. Weaver had not
realized that Commissions would be working with diminishing funds
along as a result of the diminished subscriber base.

O'Connell stated that MACTA would be back next year and the
Commissions would need to keep an eye on the DPS study. The
municipalities will need to get their foot in the door and talk to the
legislatures.

I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
