It, q CoUncilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 95-05- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO GRADE AND EXPORT SOILS WHEREAS, the Ramsey City Council adopted Resolution No. 95-08-.. adopting Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the following conditions. NOw THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1995, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Good Value Homes, Inc. ("Permit Holder") for grading operations on the property legally described as follows: Ouflot A, Chestnut Ridge, Anoka County, Minnesota. That part of the Northwest Quarter of the Northeast Quarter of Section 26 Township 32, Range 25, Anoka County, Minnesota, lying south of County Ditch//43. ("Subject Property:") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. conditions of this permit are as follows: This permit shall expire on December 1, 1995 and the Permit Holder shall be respbnsible for providing the City with at least 48 hours advance notice of the date of commencement of operations. Ail grading operations shall be conducted in accordance with the grading plan dated August 1, 1994 prepared by Passe Engineering, Inc. The proposed area to be graded is roughly sixty-five (65) acres in size. Excavation of the entire area shall be permitted. Continuation of grading shall require finished grade areas to be restored with six (6) inches of topsoil, seed and disc anchored mulch. All equipment used for grading and hauling operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the worksite regularly. The haul mute, ingress and egress, shall be as follows: south on Potassium Street N.W, west on 145th Lane N.W., and continuing west on Sunfish Lake Drive to Sunfish Lake Blvd. All worksites shall be properly safeguarded to prevent the general public from depositing garbage or other refuse on the worksite. 6.
