In no case shall the slope of the working face <br />be left unattended with a slope greater than 2 feet horizontal to I foot vertical. When <br />mining operations are anticipated to be discontinued for an interval greater than one <br />working da{y, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br /> <br />Prior to commencing any grading operations, a cash escrow or letter of credit approved as <br />to form by ~he City in the amount of Five Thousand Dollars and no cents ($5,000.00) shall <br />be depositeJgl, with the City. This f'mancial guarantee may be used by the City to pay for the <br />cost and expense of repairing any public right of ways or regrading and stabilizing eroded <br />areas due I0 the grading operation, pay for any cost associated in administering the <br />requirements of this Chapter of the City Code, and to pay for any restoration of the <br />works~te nat properly restored upon completion. <br /> <br />The Permi~ Holder shall implement sediment and erosion control practices. No grading <br />activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed <br />along the pgoperty line to prevent sediment from washing onto the adjoining property. Any <br />erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a <br />property lirie shall be mgraded within forty-eight (48) hours of the precipitation event that <br />caused the ~rosion. <br /> <br />There shallI be no stockpiling of graded materials, other than the topsoil on a temporary <br />basis, allo~ed within the boundaries of the Subject Property. Topsoil stockpiles shall not <br />exceed 900Icubic yards in total nor six (6) feet in height.' <br /> <br />The permit golder shall file with the City a liability insurance policy or certificate of such <br />insurance ~ceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />a. The po~cy shall insure the permit holder for the sum of at least $300,000 for injury to <br /> one per~n and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />b. Said policy, shall be for the full period of the permit and shall provide for the giving of <br /> 10 days prior notice to the City by registered mail of termination, cancellation or <br /> amendnlent of the policy. <br /> <br />c. In the eyent said policy is terminated for any reason, the permit shall be automatically <br /> suspenff upon the the policy unless a new <br /> . . ~. day terminates policy complying with this <br /> stem as Obtmned and filed with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the worksite shall be within the limits set by <br />the Minnes6. ta Pollution Control Agency and the Environmental Protection Agency of the <br />United Stat%. <br /> <br /> <br />
