Grading oP~erafions shah be conducted in such a manner to minimize interference with the surface wa/er drainage outside the boundaries of the operation. Fencing ma~y be ordered by the City Council or City Engineer anytime the permit is in force and shall ~ installed within 24 hours of written notice. Ail access ~ads to and from the Subject Property, shall be maintained in order to minimize dust. The maxiraum slope other than the working face shall be sloped on all sides no steeper than a rate of 2 ~oot horizontal to 1 foot vertical. In no case shall the slope of the working face be left unattended with a slope greater than 2 feet horizontal to I foot vertical. When mining operations are anticipated to be discontinued for an interval greater than one working da{y, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical. Prior to commencing any grading operations, a cash escrow or letter of credit approved as to form by ~he City in the amount of Five Thousand Dollars and no cents ($5,000.00) shall be depositeJgl, with the City. This f'mancial guarantee may be used by the City to pay for the cost and expense of repairing any public right of ways or regrading and stabilizing eroded areas due I0 the grading operation, pay for any cost associated in administering the requirements of this Chapter of the City Code, and to pay for any restoration of the works~te nat properly restored upon completion. The Permi~ Holder shall implement sediment and erosion control practices. No grading activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed along the pgoperty line to prevent sediment from washing onto the adjoining property. Any erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a property lirie shall be mgraded within forty-eight (48) hours of the precipitation event that caused the ~rosion. There shallI be no stockpiling of graded materials, other than the topsoil on a temporary basis, allo~ed within the boundaries of the Subject Property. Topsoil stockpiles shall not exceed 900Icubic yards in total nor six (6) feet in height.' The permit golder shall file with the City a liability insurance policy or certificate of such insurance ~ceptable to the City and issued by an insurance company authorized to do business in the State of Minnesota. a. The po~cy shall insure the permit holder for the sum of at least $300,000 for injury to one per~n and $500,000 for one accident, and at least $1,100,000 property damage. b. Said policy, shall be for the full period of the permit and shall provide for the giving of 10 days prior notice to the City by registered mail of termination, cancellation or amendnlent of the policy. c.
