16.1 18. Ali grading shall be completed within thirty (30) calendar days of the commencement of the grading operation. Ail costs incurred by the City in executing and administering this permit shall be the responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to reimburse the City for expenses incurred in the administration of this permit. At the time the mining operation and site restoration are completed to the satisfaction of the City, the balance of the escrow shall be returned to the Permit Holder. All grading operations shall be conducted between 7:00 a.m. and 8 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. The amount of dust or other particulate matter caused by the mining operation shall not exceed the standards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceed 30 miles per hour. 20.~ Ail operations shall comply with all applicable Minnesota Pollution Control Agency regulations and Federal and Environmental Protection Agency regulations for the protection of water quality. All haul roads are subject to the approval of the City Engineer. While hauling operations are in progress, the permit holder shall maintain the haul road in a condition satisfactory to the City Engineer. When hauling operations are completed, the permit holder shall either restore that haul road to a condition at least equal to that which existed at the time the hauling operations were started, or compensate the local road authority in an amount satisfactory to that road authority and concurred in by the City Engineer for the restoration of that haul road. The City Engineer will then accept such restoration or concur in such financial settlement for the. restoration of the haul road in writing and such acceptance will relieve the permit holder of any additional obligation in connection with the restoration of the haul roads. If the permit holder fails or refuses to perform haul road restoration or to make satisfactory financial settlement for such restoration, the City will cause the restoration work to be done and require reimbursement from the financial guarantee required herein.
