Bu~y & <br /> <br /> (THU) 08. 08' 95 14:24/8T. <br />LARK/N, HOFI~MAN, DALY & LIArDOP,.EN, LTD. <br /> <br />Carlson was required to plat a 33 foot wkle Outlot in this location for the future <br /> <br />extension of 143rd Avl;nue. Bury & Carlson. has recently obtained a copy of the preliminary plat for <br />"AEC Energy Park". We do not know whether this prelimin_ary plat has been approved by the City. Bury <br />& Carlson bas receive4 no notice of a hearing to consider the preliminary plat. The plat causes Bury <br />Carlson concern became it does not provide for rig,-of-way for the extension of 143rd Avenue. Bury & <br />Carlson requests that ~ city require AEC to deal/cate a 33 foot Outlot and extend I43rd as propose, at <br />least as far as a tempo~try cul-d~sac at the eastern edge of the Bury & Carlson property. <br /> <br />Bury & Carlson is als0 concerned about the cost of the proposed project. Bury & Carlson bas not <br />retired any notices r{garding potential assessments against its property for this project, and does not <br />know if there will be a~ny cost to them as a result of this project. Bury & Carlson would like to discuss <br />these concerns with th,~ City as soon as possible. <br /> <br />Bury & Carlson is alsQ concerned because the proposed project will apparently require that Jasper Street, <br />which Bury & Carlsofi was required to install for the City as a condition of approval of its conditional use <br />pea'mit, will be tom u~ for the utility project. Bury & Carlson would be particularly concerned if it will be <br />required to pay part o~ the cost of reconstructing the road which it has already built as required by the <br />City. <br /> <br />Finally, Bury & Car_.l~n would like to discuss several, other concerns with the City if the project does go <br />ahead as pi.armed. Th~se include the possibility of extending Jasper to Bury & Carlson's South property <br />line; requiring the contractor to deliver rubble, dirt and excess aggregate from the project to Bury & <br />Carl. son's recycling f~cility; removing thc requirement that Bury & Carlson. sweep Jasper and 143rd <br />Avenues after the City has torn up and rebuilt these streets; and el{mi_hating the City imposed restrictions <br />on Bury & Carlson's hours of operation. " <br /> <br />We ask that the City ~efer action on awarding the contract for rmprovement Project 94-20 until the <br />conc~'~rn~ set forth abqve can at least be discussed between the City and Bury & Carlson, if not resolved. <br />Please call the unders~lgned or Norman Bury (at 865-2921) if you have any questions. <br /> <br />Peter K.
