In May 1995, all <br />drainage improvements outlined in the project feasibility study were performed, with the <br />exception ot~ the installation of two culverts at each end of a pond located on the Lewis <br />property. <br /> <br />Mr. Lewis indicated that the swans he raises in the pond were nesting and could not be <br />disturbed until after the signets hatched in June. Since mid-June, I have left messages <br />several time{ on the Lewis' phone answering machine asking them to contact me so that we <br />could discus~ scheduling the work. I also have written a letter asking that some contact be <br />made as we tnust proceed on this project. <br /> <br />At the time Of this writing, I have had no response from the Lewis'. I would recommend <br />adopting th~ attached condemnation resolution for an easement which would allow the <br />construction~ and maintenance of the two culverts and also temporary access through Mr. <br />Lewis' property for their installation. <br /> <br />Adoption ofithe eminent domain resolution will not halt negotiations for the easement.
