Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br /> RESOLUTION #95-09-. <br /> RESOLUTION AUTHORIZING ACQUISIT~N OF PROPERTY FOR <br /> DRAINAGE PURPOSES / <br /> WHEREAS, the City has initiated its pub~l'ic Improvement Project ~/95-12 (the <br /> "Improvement Project") which project consists of 6onstructing drainage improvements in <br /> the area of Section #22; and / <br /> <br /> WHEREAS, a drainage easement to qertain real property is required to provide <br /> for the construction of the Improvement ProjeCt and in order to further the public health, <br /> safety and convenience of the residents of the/~ity; and <br /> <br /> WHEREAS, the City has aut~6rity to acquire the easement for the Public <br /> Improvement by eminent domain pursuanl: to Minnesota Statutes Chapter 117; and <br /> <br /> / <br /> WHEREAS, the City has the/fight to acquire the easement prior to the filing of <br /> an award by the Court ' //' ' ' <br /> appmnted comm~ssmners, pursuant to M~nnesota Statutes § 1 I7.0I 1 <br /> and § 1 t7.042; and / <br /> <br /> / <br /> WHEREAS, the property~wner of the real property which needs to be acquired <br /> has been identified by the City, as follows: <br /> PIN FEE OW.~ER REAL PROPERTY DESCRIPTION <br /> <br /> Leonard A/and Joan I. An easement rot drainage purposes as described as <br /> Lewis / follows: <br /> / Parcel 7 of City of Ramsey <br /> / Easement No. 1 <br /> <br /> / Along with a temporary access across said property for <br /> / the ingress and egress of construction equipment from <br /> / 156th Avenue N.W. to said drainage easement. The <br /> " temporary easement to expire December 1, 1996 <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMS.EY, ANOKA COUNTY, STATE OF MINNESOTA, as <br />follows: <br /> / <br />1) That the Cit~ Administrator is hereby directed to acquire the easement as described <br /> above in accordance with Minnesota Statutes.
