Councilmember adoption: introduced the following resolution and moved for its RESOLUTION #95-09-. RESOLUTION AUTHORIZING ACQUISIT~N OF PROPERTY FOR DRAINAGE PURPOSES / WHEREAS, the City has initiated its pub~l'ic Improvement Project ~/95-12 (the "Improvement Project") which project consists of 6onstructing drainage improvements in the area of Section #22; and / WHEREAS, a drainage easement to qertain real property is required to provide for the construction of the Improvement ProjeCt and in order to further the public health, safety and convenience of the residents of the/~ity; and WHEREAS, the City has aut~6rity to acquire the easement for the Public Improvement by eminent domain pursuanl: to Minnesota Statutes Chapter 117; and / WHEREAS, the City has the/fight to acquire the easement prior to the filing of an award by the Court ' //' ' ' appmnted comm~ssmners, pursuant to M~nnesota Statutes § 1 I7.0I 1 and § 1 t7.042; and / / WHEREAS, the property~wner of the real property which needs to be acquired has been identified by the City, as follows: PIN FEE OW.~ER REAL PROPERTY DESCRIPTION Leonard A/and Joan I. An easement rot drainage purposes as described as Lewis / follows: / Parcel 7 of City of Ramsey / Easement No. 1 / Along with a temporary access across said property for / the ingress and egress of construction equipment from / 156th Avenue N.W. to said drainage easement. The " temporary easement to expire December 1, 1996 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMS.EY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: / 1) That the Cit~ Administrator is hereby directed to acquire the easement as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotia?/and represent the City of Ramsey in all proceedings. 2) That if th~/easement as described above cannot be acquired by direct negotiation, it shall be ~(cquired by eminent domain. That the City Council hereby authorizes acquisition of the said easement by eminent domain and to take title and possession of that 1 and prior to filing of an award by the Court Appointed Commissioners pursuant to Minnesota Statutes §117.011 and § 117.042.
