We do not believe there would be any adverse impact on any other property owner by, allowing extended hours on a permanent basis. Condition No. I7(c) requires Bury & Carlson to sweep 143rtl Avenue to Jasper Street. Bury & Carlson also asgs that this Condition be deleted, prRnarily for liability issues, With continued development and ~onstmction of the water and sewer project in this area of the City, these streets are used t~.y a number of businesses and other users who could be respomible for depositing debris On the roadway. Bury & Carlson does not want to be liable for failure to sweep up someonei else's debris. Bury & Carlson will continue to ensure that trucks leaving its facility do not havi loose sand or gravel on them that could be deposited on the street, and to sweep up any suc~ debris if they do. However, Bury & Carlson would prefer not to be permanently responsible for sweeping the streets in this area on a weekly basis. I We would apprex~jate it if this request could be discussed by the City Council at its September 20th w~rkshop, and some preliminary indication given as to whether the Council thinks it would be ireasonable and acceptable to delete these requirements.
