We do not believe there would be any adverse impact on any other <br />property owner by, allowing extended hours on a permanent basis. <br /> <br />Condition No. I7(c) requires Bury & Carlson to sweep 143rtl Avenue to Jasper Street. Bury <br />& Carlson also asgs that this Condition be deleted, prRnarily for liability issues, With continued <br />development and ~onstmction of the water and sewer project in this area of the City, these <br />streets are used t~.y a number of businesses and other users who could be respomible for <br />depositing debris On the roadway. Bury & Carlson does not want to be liable for failure to <br />sweep up someonei else's debris. Bury & Carlson will continue to ensure that trucks leaving its <br />facility do not havi loose sand or gravel on them that could be deposited on the street, and to <br />sweep up any suc~ debris if they do. However, Bury & Carlson would prefer not to be <br />permanently responsible for sweeping the streets in this area on a weekly basis. <br /> <br />I We would apprex~jate it if this request could be discussed by the City Council at its <br /> September 20th w~rkshop, and some preliminary indication given as to whether the Council <br /> thinks it would be ireasonable and acceptable to delete these requirements.
