On August 25, 1992 the City Council
granted a conditional use permit to Bury & Carlson, Inc. to establish a demolition concrete and
asphalt processing facility on Jasper Street Northwest, between 142nd and 143rd Avenues
Northwest. This approval was subject to 25 conditions. Bury & Carlson subsequently
established the recycling facility and has operated it continuously since that time. To our
knowledge, the construction and operation of the facility has complied with all 25 conditions set
forth in the conditional use permit and the City has had no problems with this hcility,

'Fnis letter is to request that the City Council consider two revisions to the cortditions in the
permit. Condition No. 12 restricts the hours of operation at the facility to 7:00 a.m. through
5:00 p.m. Monday through Saturday. Bury & Carlson requests that this restriction be dropped,
for a munber of reasons, including:

Many roadway construction projects are done during uight time hours and on
weekends. Bury & Carlson needs to be able to supply these projects on a
24-hour a day basis.

A portion of Bury & Carlson's property is used for snow storage in the winter,
Snowplowing and hauling activities also often times occur at night and on
weekends.

Bury & Carlson has a small retail business on the site which supplies homeowners
and others with decorative rock. This business needs to be open on Sundays to
serve its customerS.

/ 70

I
I
I
I

I
I
I
I

I'
