I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br />[ I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> <br />~_n ~i '~5 t~d:~r KHI~DHLL DLHI~GOODRiCH <br /> <br />Councilmember <br />and moved f~r its adoption: <br /> <br />introduced the following resolution <br /> <br />RESOLUTION #95-09-__ <br /> <br />RESOLUTION iAUTHORIZING ACQUISITION OF PROPERTY FOR DRAINAGE <br />PURPOSES. ~ <br /> <br /> WHEREAS, the city has initiated its public Improvement Project <br /> ~ "Improvement Project") which project consists of <br />95-12 (the~ <br />constructin~ drainage improvements in a portion of the North Half <br />of the NorriS. east Quarter of Section 22, Township 32, Range 25 and <br />part of the Southeast Quarter of the Southwest Quarter, Section 15, <br />Township 32~ Range 25, Anoka County, Minnesota; and <br /> WHEREAS, a perpetual drainage easements over, under and across <br />certain real property are required to provide for the construction <br />of the Improvement Project and in order to further the public <br />health, safety and convenience of the residents of the City; and <br /> <br /> WHEREA~, the City has authority to acquire the easements for <br />the Public Improvement by eminent domain pursuant to Minn. Stat. <br />Chapter 117;i and <br /> <br /> WHEREA~, the City has the right to acquire the easements prior <br />to the filing of an award by the Court appointed commissioners, <br />pursuant to ~inn. Stats. §117.011 and §117.042; and <br /> <br /> WHEREA~, the property owners of the parcels of real property <br />which are ~ffected by the easements to be acquired have been <br />identified b~ the city as follows: <br /> <br />Lawrence B. Shaw <br />and Hazel ~. Shaw, <br />husband arid wife as <br />joint tenan~ <br /> <br />Fk3rence J. Petterson <br /> <br />Earle T.
