I ~_n ~i '~5 t~d:~r KHI~DHLL DLHI~GOODRiCH Councilmember and moved f~r its adoption: introduced the following resolution RESOLUTION #95-09-__ RESOLUTION iAUTHORIZING ACQUISITION OF PROPERTY FOR DRAINAGE PURPOSES. ~ WHEREAS, the city has initiated its public Improvement Project ~ "Improvement Project") which project consists of 95-12 (the~ constructin~ drainage improvements in a portion of the North Half of the NorriS. east Quarter of Section 22, Township 32, Range 25 and part of the Southeast Quarter of the Southwest Quarter, Section 15, Township 32~ Range 25, Anoka County, Minnesota; and WHEREAS, a perpetual drainage easements over, under and across certain real property are required to provide for the construction of the Improvement Project and in order to further the public health, safety and convenience of the residents of the City; and WHEREA~, the City has authority to acquire the easements for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117;i and WHEREA~, the City has the right to acquire the easements prior to the filing of an award by the Court appointed commissioners, pursuant to ~inn. Stats. §117.011 and §117.042; and WHEREA~, the property owners of the parcels of real property which are ~ffected by the easements to be acquired have been identified b~ the city as follows: Lawrence B. Shaw and Hazel ~. Shaw, husband arid wife as joint tenan~ Fk3rence J. Petterson Earle T. Jerde and Diane V, J~rde, husband and wife as joint tenants Richard E.
