Oct. 10, 1995 <br /> <br />Ramsey City Council <br /> <br />REF: Amending Thoroughfare Setback. <br /> <br />Mr. Jankowski has resisted the effort by the Planning commission to amend the Zoning <br />ordinance for Three years. If has been a pending agenda item for more than 2 years. <br /> <br />He is still resisting the change. <br /> <br />The Planning Commission Voted Unanimously to amend Chapter 9 to replace the <br />wording, "50 feet from lhe right-of-way line, or 110 feet from the center line, whichever <br />is greater." to "83 feet from the center of the road right-of-way." By the way, the first <br />motion by me was for "88 feet" and was reduced by amendment to 83 feet. <br /> <br />The above change would put back in effect a minimum setback along County and state <br />roads within the City of Ramsey. The original setback along these roads was put in <br />effect in the early 80's and was also a motion by me for 50 feet from the righl-of-way. <br />At that time only Nowthen Blvd and Sunfish Lake Blvd. had the current 120 foot right-of <br />way. <br /> <br />On the attached sheets of ACHD policy, is some of the reason for confusion. When the <br />Planning Commission staffed on this item: <br /> What is listed MINOR ARTERIAL A'S - A 226 foot right-of-way was ~hown as <br /> (two years ago) Miner Aflerial B's. <br /> What is listed as MINOR ARTERIAL B'S -A 120 fool right-of-way was shown as <br /> (two years ago) Rural Collector. <br /> What is listed as COLLECTORS AND BELOW -A 100 foot right-of-way was (two <br /> years ago) Urban Collector. <br /> <br />No where in this effort does lhe Planning Commission intend to reduce any of the Zone <br />Specific setbacks. If somebody's side yard is a county road of 66 foot right-of-way, lhey <br />will have to setback 83 feet. When the Counly expands thal road to MINOR ARTERIAL <br />B, lhat person will be 3 feet farlher than the 20 feet required by R-1 sideyard setback. <br />By definition, and county policy not to allow direct access to county roads, this should <br />be sufficient. <br /> <br />This has been in the past the most requested Variance. It has not been uniformly <br />applied in all circumstances. There are more than 10 commercial buildings that have <br />been constructed closer than 50 feet of the right-of-way since that was adapted as <br />ordinance in this city. <br /> <br />Sincerely, <br /> <br />Ben.
