CITY OF RAMSEY POLICY <br /> <br />PROVISIONS FOR TEMPORARY STRUCTURES <br /> IN EMERGENCY SITUATIONS <br /> <br />If the need for a temporary structure has arisen as a result of any casualty, including without <br />limitation fires, storms, vandalims or other casualty, resulting in the destruction or damage to the <br />point of uninhabitability of a pre-existing dwelling or office, thereby rendering the former occupant <br />without shelter for the previous usage, the City Administrator or his/her designee may issue an <br />Emergency Temporary Structure Permit without the City Council approval, upon finding that: <br /> <br />The destruction or damage to the previous structure was not by the deliberate act of <br />the occupant or owner;, <br /> <br />b) <br /> <br />The previous structure was, at the time of damag.e or destruction, being used as an <br />office or dwelling in accordance with all City requn:ements; <br /> <br />c) <br /> <br />The denial of the use of a temporary structure on the Subject Property during <br />reparation would, in the case of a dwelling, leave persons without adequate shelter <br />and under the circumstances, a reasonable degree of normalcy; or in the case of a <br />business, unreasonably restrict the business from carrying on its trade. <br /> <br />Said emergency permit shall be effective for ninety (90) days from the date of issuance and one <br />ninety (90) day extension may be granted by the City Administrator upon a determination that <br />reparation of the previous structure is progressing satisfactorily. No occupancy of the temporary <br />smacture shall be permitted beyond the expiration of the ninety (90) day extension period unless <br />prior approval has been obtained from the City Council. <br /> <br />The Permittee shall be requked to place a financial surety at the City, in an amount to be determined <br />from time to time by City Council Resolution, to ensure the timely removal of the temporary <br />structure, the removal of temporary utility connections, and restoration of the Subject Property to <br />its original condition prior to the casualty. Upon verification that the temporary structure has been <br />removed from the Subject Property, the financial surety shall be returned to the Permittee. <br /> <br />In the event the permittee fails to comply, the City may complete or perform any remedial action <br />necessary with City day labor and/or by letting contracts for said remedial action and draw upon <br />the surety for payment. Any expenses incurred by the City in excess of the surety amount shall be <br />the responsibility of and billed to the Permittee. Said expenses shall be paid within thirty (30) days <br />of billing by the City. Failure of the Permittee to comply with the payment requirement shall give <br />the City Administrator authority to extend such sum, plus 25% thereof for administrative costs, as <br />a special tax against the property and to certify the same to the County auditor for collection in the <br />same manner as taxes and special assessments are certified and collected. The Permittee hereby <br />grants permission and a license to the City and/or its contractors and assigns to enter upon the <br />Subject Property for the purpose of performing remedial action in the event of the Permittee's <br />default. <br /> <br /> <br />
