W~ERF2%9, the City has initiated its public Improvement Project 95-12 (theI "Improvement Project") which project consists of constructin~ drainage improvements in a portion of the North Half of the Northeast Quarter of section 22, Township 32, Range 25 and part of the!Southeast Quarter of the Southwest Quarter, section 15, Township 321, Range 25, Anoka County, Minnesota; and WHERE., a perpetual drainage easements over, under and across certain rea:~i property are required to provide for the construction of the Improvement Project and in order to further the public health, safety and convenience of the residents of the City; and WHERE"~S;_, the City has authority to acquire the easements for the Public iImprovement by eminent domain pursuant to Minn. Stat. Chapter 117[; and WHEREA~, the city has the right to acquire the easements prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and WHEREA~, certain of the property owners of the parcels of real property which are affected by the easements to be acquired have been identffied in City Resolution 95-09- ; and WNERE$, the City has identified parcels and property in addition to those identified in Resolution 95-09- which additional Iparcels and property are necessary to acquire in order to construct the project; and WHERE., the additional parcels and additional property have been identified as follows: FEE OWNER Robert J~ Arnold & Mary t.
