MOV 08 '95 05:2-~- RANDALL DEHMGOODRICH <br /> <br />P.~/4 <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br /> <br />Councilmemb,er <br />and moved for its adoption: <br /> <br />introduced the following resolution <br /> <br />RESOLUTION #95-11- <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR DRAINAGE <br />PURPOSES. <br /> <br /> W~ERF2%9, the City has initiated its public Improvement Project <br />95-12 (theI "Improvement Project") which project consists of <br />constructin~ drainage improvements in a portion of the North Half <br />of the Northeast Quarter of section 22, Township 32, Range 25 and <br />part of the!Southeast Quarter of the Southwest Quarter, section 15, <br />Township 321, Range 25, Anoka County, Minnesota; and <br /> <br /> WHERE., a perpetual drainage easements over, under and across <br />certain rea:~i property are required to provide for the construction <br />of the Improvement Project and in order to further the public <br />health, safety and convenience of the residents of the City; and <br /> <br /> WHERE"~S;_, the City has authority to acquire the easements for <br />the Public iImprovement by eminent domain pursuant to Minn. Stat. <br />Chapter 117[; and <br /> <br /> WHEREA~, the city has the right to acquire the easements prior <br />to the filing of an award by the Court appointed commissioners, <br />pursuant to Minn. Stats. §117.011 and §117.042; and <br /> <br /> WHEREA~, certain of the property owners of the parcels of real <br />property which are affected by the easements to be acquired have <br />been identffied in City Resolution 95-09- ; and <br /> <br /> WNERE$, the City has identified parcels and property in <br />addition to those identified in Resolution 95-09- which <br />additional Iparcels and property are necessary to acquire in order <br />to construct the project; and <br /> <br /> WHERE., the additional parcels and additional property have <br />been identified as follows: <br /> <br />FEE OWNER <br /> <br />Robert J~ Arnold & Mary t. <br />ArnoJd <br /> <br />Robert D.
