Subdivision - Design Standards § 9.50.30 <br /> <br />The formula for land dedication shall be based on <br /> Dwelling Units <br /> <br /> 0 - 0.3 units per acre <br /> 0.31 - 3.0 units per acre <br /> 3.1 - 5.0 units per acre <br /> 5.1 + units per acre <br /> <br />the number of proposed units per acre. <br /> Land To Be Dedicated <br /> <br />7% <br /> <br />10% <br /> <br />12% <br /> <br />Add .5% for each unit over 5 <br /> <br /> Subd. 3. Industrial/commercial parkland dedication. <br />Subdividers of commercia!fmdustrial land, including commercialfmdustrial portions of <br />planned unit developments, shall be required at the time the final plat is approved to <br />dedicate to the City for park, playground, and public open space purposes, an amount of <br />land up to five percent (5%) of the gross land area as determined by the Council. <br /> <br /> Subd. 4. Planned unit development (PUD's). Parkland <br />dedication requirements for PUD's shall provide a minimum of ten percent (10%) for <br />public open space and recreational uses or cash in lieu of land in addition to those special <br />requirements in §9.20.31. <br /> <br /> Subd. <br />park purposes. <br /> <br />5. Standards for accepting dedication of land for public <br /> <br /> a. Land proposed to be dedicated for public purposes shall meet the <br /> needs of the City. <br /> <br /> b. Prior to dedication for public purpose, the subdivider shall <br /> deliver to the City Attorney, an abstract of title or registered <br /> property abstract for such dedication. Such title shall vest in the <br /> City good and marketable fl0e, flee and clear of any mortgages, <br /> liens, encumbrances, assessments and taxes. The conveyance <br /> documents shall be in such form acceptable to the Council. <br /> <br /> c. The required dedication shall be made at time of final plat <br /> approval. <br /> <br /> d. The removal of trees, topsoil, storage of construction <br /> equipment, burying, of construction debris, or stockrpiling of <br /> surplus soils is strictly forbidden without the written approval of <br /> the Council. <br /> <br /> e. Grading and utility plans, which may affect or impact the <br /> proposed park dedication, shall be reviewed and approved by <br /> the Parks ~n~ Recrea~c.n Ce~2sslon City Engineer prior to <br /> dedication, or at such time as is reasonably determined. <br /> <br /> f. To be eligible for park dedication credit, any land to be dedicated <br /> as a requirement of this section shall be useable, developable <br /> land for use for park and recreation purposes and shall be at a <br /> location convenient to the people to be served. <br /> <br /> Subd. 6. Cash payment. In lieu of land dedicatioti, the Council may <br />require the subdivider to contribute a cash payment. The value of such payment shall be <br />the greater amount established by a specified contribution per dwelling unit or a percent of <br />fair market value of the undeveloped land commensurate with the perceht of land which <br />otherwise would have been required under §9.50.37 Subd, 2 ~d §9.50.37 Subd. 3.
