Should the Zoning Administrator determine the <br />moving of interior lot lines may have an adverse effect on either <br />adjoining property or may circumvent other applicable zoning <br />restrictions, the Zoning Administrator then shall require the <br />subdivision to proceed to Council pursuant to applicable <br />provisions of this Code. <br /> <br />Building Permits. No building permit shall be issued for the <br />construction of a structure on lots or tracts divided or <br />consolidated contrary to the provisions of this subsection. <br /> <br />9.50.37 Park and open space dedication. <br /> <br /> Subdivision l. Purpose. The Council recognizes it is essential to the <br />health, safety and welfare of the residents of the City and persons working in the City, that <br />the character and quality of the environment be considered to be of major importance in the <br />planning an&development of the City. In this regard, the manner in which land is <br />developed and used is of high priority. The preservation of land for park, playground and <br />public open sgace purposes as it relates to the use and development of land for residential, <br />commercial/iadustrial purposes is essential to the maintaining of a healthful and desirable <br />environment for all citizens of the City. The City must not only provide these necessary <br />amenities for Our citizens today, but also be insightful to the needs of our furore citizens. <br /> <br />It is recognized by the Council that the demand for park, playground and public open space <br />within a mufiicipality is directly related to the density and intensity of development <br />permitted and~ allowed within any given area. Higher density developments mean greater <br />numbers of p_~ople and an increased demand for parks, recreational resources and public <br />open space. T;o disregard this principle is to inevitably over-tax existing facilities and thus, <br />diminish the ciuality of the environment for all. <br /> <br />The City's Comprehensive Park and Open Space Plan establishes minimum criteria for <br />meeting the n~ds of the residents of City. <br /> <br />It is the policyi of the City that the following standards and guidelines for the dedication of <br />land for park, playground, and public open space purposes (or cash contributions in lieu of <br />such dedicatic/~l) in the subdividing and developing of land within the City shall be directly <br />related to the density and intensity of each subdivision and development. It is further the <br />policy that it! is intended that subdivision dedication shall first be allocated toward <br />deficiencies ir[ the subdivision, neighborhood or specific district park(s), then to trails <br />linking parks, then community parks, then multi-jurisdictional park(s) in the City. Finally, <br />that dedicatiori fees recognize the impact upon each of these systems by the subdivision of <br />land. <br /> <br />Subd. 2. :Residential parkland dedications. The amount of land to be <br />dedicated by a subdivider for residential development shall be based on the gross area of <br />the proposed subdivision, proposed type of dwelling unit and density. <br /> <br />/z3 <br /> <br /> <br />
