We do not believe there would be any adverse impact on any other <br />property owner by allowing extended hours on a permanent basis. <br /> <br />Condition No. 17(c) requires Bury & Carlson to sweep 143rd Avenue to Jasper Street. Bury <br />& Carlson also asks that this Condition be deleted, prknarily for liability issues. With continued <br />development and construction of the water and sewer project in this area of the City, these <br />streets are used by'a number of businesses and other users who could be responsible for <br />depositing debris on the roadway. Bury & Carlson does not want to be liable for failure to <br />sweep up someone else's debris. Bury & Carlson will continue to ensure that trucks leaving its <br />facility do not have loose sand or gravel on them that could be deposited on the street, and. to <br />sweep up any such debris if they do. However, Bury. & Carlson would prefer not to be <br />permanently responsible for sweeping the'streets in this area on a weekly basis.. <br /> <br />'We would appreciate it if this request could be. discussed by the" City Council at its <br />September 20th workshop, and some preliminary indication given as to whether the Council <br />thinks it would be reasonable m~d acceptable to delete these requirements.
