We do not believe there would be any adverse impact on any other property owner by allowing extended hours on a permanent basis. Condition No. 17(c) requires Bury & Carlson to sweep 143rd Avenue to Jasper Street. Bury & Carlson also asks that this Condition be deleted, prknarily for liability issues. With continued development and construction of the water and sewer project in this area of the City, these streets are used by'a number of businesses and other users who could be responsible for depositing debris on the roadway. Bury & Carlson does not want to be liable for failure to sweep up someone else's debris. Bury & Carlson will continue to ensure that trucks leaving its facility do not have loose sand or gravel on them that could be deposited on the street, and. to sweep up any such debris if they do. However, Bury. & Carlson would prefer not to be permanently responsible for sweeping the'streets in this area on a weekly basis.. 'We would appreciate it if this request could be. discussed by the" City Council at its September 20th workshop, and some preliminary indication given as to whether the Council thinks it would be reasonable m~d acceptable to delete these requirements.
