Councilmember h!.trosfiuced the folloWing resolution and moved for its adoption: RESOLUTION NO. 95-11- A RESOLUTION APPROVING THE ISSUANCE OF A PERMIT BASED ON FINDINGS OF FACT # AND OF PERMIT TO GRADEr EXPORT AND 1MP0-RT"~OILS WHEREAS, Findings of Fact following conditions. CONDITIONAL USE DECLARING TERMS the Ramsey City Council adopted Resolution No. 95-11- adopting for this use and herein approves the Conditional Use Permit subject to the NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On 1995, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to North Fork, Inc. ("Permit Holder") for grading, exporting and importing operations on the property legally described as follows: Part of Outlot C, NORTI-~O~ ADDITION, Anoka County, Minnesota. ("Subject Property") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. conditions of this permit are as follows: 1. This permit shall expire on ,19 Ail equipment used for grading and hauling operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the worksite regularly. All worksites shall be properly safeguarded to prevent the general public from depositing garbage or other refuse on the worksite. Existing tree and groundcover shall be preserved to the extent feasible. Gm_ding operations shall be conducted in such a manner to minimize interference with the surface water drainage outside the boundaries of the operation. Fencing may be ordered by the City Council or City Engineer anytime the permit is in force and shall be installed within 24 hours of written notice. All access roads to and from the Subject Property, shall be maintained in order to minimize dust. The maximum slope other than the working face shall be sloped on all sides no steeper than a rote of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working face be left unattended with a slope greater than 3 feet horizontal to 1 foot vertical. When mining operations are anticipated to be discontinued for an interval greater than one working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical.
