Prior to corr~haencing any grading operations, a cash escrow or letter of cre~t approved as to form by Oe City in the amount of Five Thousand Dollars ($5,000.00) shall be deposited with the Cit~. This financial ~tee may be used by the City to pay for the cost and expense of r~pairing any public right of ways or regrading and stabilizing eroded areas due to the gradiOg operation, pay for any cost associated in administering the requirements of this Chapter,of the City Code, and to pay for any restoration of the worksite not properly restored upon completion. The Permit ~older shall implement sediment and erosion control practices. No grading activity shal~ occur within twenty-five (25) feet of a property line unless silt fence is placed along the property line to prevent sextiment from washing onto the adjoining property. Any erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a property linq~ shall be regraded within forty-eight (48) hours of the precipitation event that caused the ,..dgosion. There shall ~e no stockpiling of graded materials, other than the topsoil on a temporary basis, allow{~d within the boundaries of the Subject Property. Topsoil stockpiles shall not exceed 900 ~ubic yards in total nor six (6) feet in height. The type ~maported soils shall be subject to the prior approval of the City The permit holder shall file with the City a liability insurance policy or certificate of such insurance ~cepmble to the City and issued by an insurance company authorized to do business in ~he State of Minnesota. a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one per.qon and $500,000 for one accident, and at least $1,100,000 property damage. b. Said percy shall be for the full period of the permit and shall provide for the giving of 10 day~, prior notice to the City by registered mail of termination, cancellation or amcndntent of the policy. c. In the e~,ent said policy is mrminated for any reason, the pen:nit shall be automatically suspend~..d upon the day the policy mnninatcs unless a new policy complying with this item is (Ibtained and filed with the City prior to the termination of the policy in force. Thc maximm'n noise level at the perimeter of the worksite shall be within the limits set by the MinnesOta Pollution Control Agency and the Environmental Protection Agency of the United Stat~s. All grading operations shall be conducted in accordance with the grading plan dated October 17~ 1995 prepared by Ulteig Engineers, Inc. The proposed area to b~ graded is roughly two acres in size. Excavation of the entire area shah be permitted. Continuation of grading shall require finished grade areas to be restored with four (4) inches of topsoil, seed and disc anchored mulch. All restorati, on shall consist of spreading a minimum of four (4) inches of topsoil, fertilizer, seed and m~alch.
