This financial ~tee may be used by the City to pay for the cost and <br />expense of r~pairing any public right of ways or regrading and stabilizing eroded areas due <br />to the gradiOg operation, pay for any cost associated in administering the requirements of <br />this Chapter,of the City Code, and to pay for any restoration of the worksite not properly <br />restored upon completion. <br />The Permit ~older shall implement sediment and erosion control practices. No grading <br />activity shal~ occur within twenty-five (25) feet of a property line unless silt fence is placed <br />along the property line to prevent sextiment from washing onto the adjoining property. Any <br />erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a <br />property linq~ shall be regraded within forty-eight (48) hours of the precipitation event that <br />caused the ,..dgosion. <br />There shall ~e no stockpiling of graded materials, other than the topsoil on a temporary <br />basis, allow{~d within the boundaries of the Subject Property. Topsoil stockpiles shall not <br />exceed 900 ~ubic yards in total nor six (6) feet in height. <br />The type ~maported soils shall be subject to the prior approval of the City <br /> <br />The permit holder shall file with the City a liability insurance policy or certificate of such <br />insurance ~cepmble to the City and issued by an insurance company authorized to do <br />business in ~he State of Minnesota. <br /> <br />a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to <br /> one per.qon and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />b. Said percy shall be for the full period of the permit and shall provide for the giving of <br /> 10 day~, prior notice to the City by registered mail of termination, cancellation or <br /> amcndntent of the policy. <br /> <br />c. In the e~,ent said policy is mrminated for any reason, the pen:nit shall be automatically <br /> suspend~..d upon the day the policy mnninatcs unless a new policy complying with this <br /> item is (Ibtained and filed with the City prior to the termination of the policy in force. <br /> <br />Thc maximm'n noise level at the perimeter of the worksite shall be within the limits set by <br />the MinnesOta Pollution Control Agency and the Environmental Protection Agency of the <br />United Stat~s. <br />All grading operations shall be conducted in accordance with the grading plan dated <br />October 17~ 1995 prepared by Ulteig Engineers, Inc. The proposed area to b~ graded is <br />roughly two acres in size. Excavation of the entire area shah be permitted. Continuation of <br />grading shall require finished grade areas to be restored with four (4) inches of topsoil, <br />seed and disc anchored mulch. <br />All restorati, on shall consist of spreading a minimum of four (4) inches of topsoil, fertilizer, <br />seed and m~alch. <br /> <br /> <br />
