I <br />I <br />I <br /> <br />§ 7.52 Intoxicating Liquor for On,sale. <br /> <br /> :vocation. and shall revoke for failure to keep the insurance required by this <br /> in full force and effect. <br /> <br /> b. It' the premises is not ready for occupancy within one year after the initial <br /> l}cense is issued, the license shall be revoked and will not be reissued. The <br /> l}censee may make an application for a new license, but will be given no <br /> .,~ecial consideration as opposed to any other applicants. <br /> [ <br />7.52.18 .Rev6ication procedure. Except in the case of a suspension pending a <br />heating on revocatioq, revocation or suspension by the council shall be preceded by written notice <br />to the licensee and a ~ublic heating. The notice shall give at least ten (10) days notice of the time <br />and place of the heari,hg ,and shall state the general nature of the charges against the licensee. The <br />council may, without [an3 notice, suspend any license pending a hearing or revocation for a period <br />not exceeding thirty [(30) days. The notice may be served upon the licensee personally or by <br />leaving the same at t}ie licensed premises with the person in charge thereof. No suspension shall <br />:xceed sixty (60) da ~. <br /> <br />7.52.19 Liceflse year. An "on-sale" license expires June 30 of the following year of <br />its effective date. Th{: fee for an "on-sale" license granted after the commencement of the license <br />year shall be prorated ion ~' monthly basis. <br /> <br />7.52.20 Enla 'gement, alterations, or extension, of premises. Proposed <br />enlar-,,ement, aheratirJn or extension of premises previously licensed shall be reported to the city <br />:tdmi~istrator at or bet~ore the time the application is made for a building permit for an3, such change <br />and the licensee shall !also give such information as is required by §7.52.05. <br /> <br />7.5 2.21 Existing,, licens,,es. Any "on-sale" licensee within the corporate boundaries of <br />the city, holding a valid on-sale liquor license on the effective date of this code, which license <br />was _v. ranted by an aplbropriate political subdivision of the State of Minnesota, shall be considered <br />for fl'i'e purposgs of thils chapter to have a valid existing license and said licensee need not apply for <br />a new license as pro$,ided in {}7.52.03 to {}7.52.02 herein. All other provisions of this chapter <br />shall be applicable to ~aid existing licensee. <br /> <br />7.52.22 Penalty. Any person violating any provision of this ordinance is guilty of a <br />misdemeanor and upon conviction shall be punished by a fine of not more than Seven Hundred <br />Dollars ($700.00) or '_~-nprisonment for not more than ninety (90) days or both. <br /> Hist6rical Note <br /> <br /> Established by Ord. 75-7, Ma), 27, 1975. <br /> <br /> Ord. 75-16, amends the Liability Insurance Section <br />changing the coverage}required from not less than <br />S300,000 to not less th~ 5;100,000 for one person, and <br />from not less than Sl001000 to not less than 5;300,000 <br />for more than one persot~. <br /> <br /> Ord. 77-1, amends §14 (now §7.52.15), establishing <br />Subd. 3, which penmts ~e public to remain present in <br />"on-sale" liquor establ!shments after the stipulated <br />hours of operation, providing all liquor is prohibited <br /> [. <br />from sale and secured du~mg those hours. <br /> <br /> Ord. 81-6, amends §~7.52.08, Subd. 6 adding the <br />following to the list o~ circumstances which might <br />allow for a partial refund of the license fee on a prorata <br /> <br />basis when operation of the business ceases before <br />expiration of the license. "The transfer of ownership of <br />the licensed premises and than only when the new <br />owner on ~ansfer receives a license under this Chapter <br />and has paid the appropriate pro ram license fee such <br />that the city will receive a full license fee for that <br />particular license year". <br /> <br /> Ord. 82-9, amends §7.52.15, Subd. 2, changing the <br />special Sunday "on-sale" liquor hours to between 10:00 <br />a.m, and 12:00 midnight.
